As was explained in an update issued last week, on June 2, 2011, the District Court for Denton County, Texas issued an Order authorizing the taking of a deposition of Eric A. Ferguson to investigate a claim related to the breach of confidential pilot information.
Pursuant to that Court Order, a sworn deposition of Eric Ferguson was taken Friday, June 9, 2011 in Denton, Texas. The deposition was conducted by Association attorneys and present on behalf of the Association was Communications Vice Chairman Todd Fieser. Eric Ferguson was represented by counsel and the deposition lasted approximately six and one half hours. During that time, detailed information surrounding the breach and distribution of confidential pilot data was elicited from Mr. Ferguson.
Also in relation to its investigation of this data breach, USAPA has filed a Petition for Pre-suit Discovery in the Circuit Court of Limestone County located in Athens, Alabama in an effort to secure a court order mandating that pre-suit discovery, including a deposition, be taken of John Scherff - the pilot alleged to have disseminated the database to Leonidas during his tenure as an Assistant Chief Pilot. Similar to the Denton, County Court in Texas, the Alabama Court has scheduled a hearing to be held on Friday, July 22, 2011 at 9:00AM to determine whether to grant the Petition and order the pre-suit discovery. We will provide further updates following conclusion of that hearing.
