As was explained in an update issued last week, on June 2, 2011, the District Court for Denton County, Texas issued an Order authorizing the taking of a deposition of Eric A. Ferguson to investigate a claim related to the breach of confidential pilot information.

Pursuant to that Court Order, a sworn deposition of Eric Ferguson was taken Friday, June 9, 2011 in Denton, Texas. The deposition was conducted by Association attorneys and present on behalf of the Association was Communications Vice Chairman Todd Fieser. Eric Ferguson was represented by counsel and the deposition lasted approximately six and one half hours. During that time, detailed information surrounding the breach and distribution of confidential pilot data was elicited from Mr. Ferguson.

Also in relation to its investigation of this data breach, USAPA has filed a Petition for Pre-suit Discovery in the Circuit Court of Limestone County located in Athens, Alabama in an effort to secure a court order mandating that pre-suit discovery, including a deposition, be taken of John Scherff - the pilot alleged to have disseminated the database to Leonidas during his tenure as an Assistant Chief Pilot. Similar to the Denton, County Court in Texas, the Alabama Court has scheduled a hearing to be held on Friday, July 22, 2011 at 9:00AM to determine whether to grant the Petition and order the pre-suit discovery. We will provide further updates following conclusion of that hearing.

ALPA is an option, albeit a lazy one. While ALPA might have a moderating effect on the schizophenic behavior of USAPA leadership and could offer a brand-name identity to public relations, that would be over shadowed by the polarizing nature of returning to the former agent. It would undermine the fundemental core of building unity which itself is fundemental to relevance, and would be, in my opinion, a false economy.

The pilots who want to work together to build an entirely new union founded, built and implemented with equal contributions from east and west will not be satisfied with a tune-up of USAPA. There are pilots committed to serving all the interests of the US pilot group and have a clear understanding of the difference between making a necessary but unpopular decision and disenfranchising an entire portion of the pilot group. They are the ones who will be soliciting cards to oust USAPA.

The pilots are basically down to 2 choices: Build an entirely new union founded in unity rather than partisan power grabs OR continue to pay tribute to an arrogant tyrant whose behavior proves his disdain for the line pilot and in doing so support a union that can only survive by perpetuating the civil war they created.
 
If it were not for EF putting up over $30K of his own money to start a defense fund, the ochlocracy known as USAPA would have cashed the DOH lottery ticket three years ago. I
got a good laugh about the recent filing in Denton, TX. Eric did not even show up in court
whch tells me he's not at all concerned about another one of Lee's wild goose chase which Cleary blindly follows. Addressgate is a dead issue and he knows it. The persuit of EF is nothing more than an attempt to harrass a West pilot for standing up to a mob.

We now have the unity to continue our defense whether the name is Leonidas, AWAPPA or whatever. So, if you think you have EF on the ropes, he is just one of more than 1600 who have the same determination to defend their careers at all costs.

Keep filing those lawsuits, you might as well forget about the war chest.

Was Eric's deposition held in court? Normally they are taken at a law office or some other site than a courthouse. He can be represented by an attorney in court but has to be present at a deposition.

You would think after more than 6 hours of questioning, USAPA would have more to report. Could it be there was nothing to report? :unsure:

Ok, sure. I'll just continue to be stagnant (and happy) on the 76! At this point I can't see putting myself through 6 weeks to 2 months of misery for a couple of bucks. Besides the 75/76 gets to fly a little bit of domestic now and then.

Why does anyone think Bob is unique? Why is beyond all belief that there are not many (if not most) of the west pilots who would gladly remain in PHX for a little while longer rather than drag themselves all the way to CLT or PHL every week in pursuit of an upgrade or widebody?

USAPA has conditioned the east to believe that every west pilot will flood into the east bases and keep them from ever advancing, when in fact under the Nic, most east pilots will see little if any change to their upgrade time regardless of when the guy ahead of him on the list was hired.

That's the reality, brought to you courtesy of your very own Bob.

You guys will hole up in the mountains of N.C. in communities. You will learn to make shine. Your kids will grow up to be like Boeing Boy. Believe me, this is all for your own good. 😀

Displacements come as a result of the the airline about to crater. This place doesn't have enough altitude to survive another one of those. If you think that's a real possibility in the near term, you better start looking for another job now.

The rising-tide scenario is much more likely and is the one that an integration plan should be based upon.

Wow, you haven't changed a bit since you went after Parker in that crew news with the kid! That, was pathetic. Research? This is not a chemistry experiment. Simply a criminal matter involving a bunch of people who were doing things they shouldn't have, and will now face justice.
