Thank you! You quote exactly what Hollerbach failed to read. Nowhere is the word AMENDABLE used, the LOA93 rates EXPIRE 12/31/2009. BIG DIFFERENCE. Had the term AMENDABLE been used, we wouldn't even have gone to Kasher for this arb. The LOA93 rates EXPIRE 12/31/2009, at which time we return to the UNDERLYING LOA84 rate structure that (I hate to say this) Don B. actually got right this time.

Hollerbach also fails miserably in the prediction of the shortest arbitration in history LOL!



Looks like I have to bring Hollerbach's email out:

'There was one mention of a snapback in the negotiations surrounding LOA 93 and that was on day 1, the first pass of the pilots' proposal to the Company where we addressed snapback to previous rates. The Company unequivocally rejected the notion as the financial situation was so dire (and it was dire) that to achieve financing, a projected snapback would not be received favorably by lenders or investors."

"There is no snapback, no term on rates, except that the contract becomes amendable on December 31st 2009. To tell you that USAPA doesn't have a chance in this grievance is an understatement... The problem at hand is that there is nothing to support the union position from a practical standpoint. Trust me, I would love a snap back to previous rates, but I won't commit perjury to get there when it isn't the truth. This particular arbitration will, in my view, be the shortest in history and it won't be favorable for the pilot group."

placing a new hire (3 months) senior to a 17 year dues paying never furloughed pilot is NEVER acceptable
to someone with a ounce of decency and respect for the job. Not that junior east guys fault that management never managed...
paid 2 billion for 2 companies and did not know what to do with....then dismantled both pissing away 2 billion (PSA/Piedmont)
and then later spent 1.5-2 billion buying stock back to further enrich themselves at ouy expense....think U could have used tht 2 billion after 9-11
AND THEN THE ARBITRATOR USES THE FINANCIAL WEAKNESS TO PENALYZE THIS GROUP.

PS our furloughed guys were placed at the bottom....hard to argue with that....but before the NIC list was even put out 500
of them were back working......but still junior to the 2-3 month guys...Sorry no surrender!!!

Well you guys agreed to binding arbitration, you guys were alpa, you gave your word to honor, you put your integrity on the line. Then when things went not in your favor you renigged, this is what you are teaching to your children to renig on a deal, on a contract, on your word,. Preposterous to say well NIC was not formed under on unified contract so we dont have to honor it. Then why did you go to arbitration? You guys should have said NO before not after the NIC decision was made. Simplly you have no honor. There is NO DOUBT you will lose in the court, the question is do you want to lose to your wife, family, friends.

For some reason US air , you guys just dont get it, you were bankrupt, white kinight after white knight SAVED YOU. You had one foot in chapter 7, literally 7 days away. (proof was found through money drawn on by white knight, just looks at dates)

Now was america west in great shape? NO of course not, but Us Air was gone bye bye.

Now why dont one of you guys call usapa and tell them to put out a press release about how they lost their motion on june 1st or there about I believe, you put out the press release on may 31 saying you were suing I see it all over the google. the motion where you were trying to sue us airways because us airways wanted clarity on how to proceed with a new contract, pretty sad indeed. come on call them get the facts out about how you lost again.

Look both parties need to get together, not the top union people but the regular reasonable honest folk, the folk with integrity, the union needs to pay for these people to get together, to go to a ball game, to go golfing, to go to dinner, to talk about life, family, to take a seminar on ethics, integrity etc. the finally to start to talk about work and contracts. A mediator needs to be involved in this process.

This back and forth has got to stop, I dont know this usapa group may have already caused fatal damage, time will tell. Shame on you guys , shame on you.

We gave our word to follow the guidelines that Alpa put forth. We feel that the guidelines were not followed. If someone is found guilty of lets say armed robbery. While he's in jail his lawyer finds evidance that proves he is innocent........should he just rot in jail because one judge says Guilty?

That is not why I voted it in. The pension and LOA 93 was it for me. Put me on the stand, any day, any time.
Really! Yet when it came time for a rallying crywhat did you use? Replace my pension? Fix LOA 93?

NO! You had yellow lanyards that said "SENIORITY MATTERS"

So don't even try and lie that replacing ALPA with usapa was not about seniority and the Nicolau.
