The Nic was indeed for a specific set of circumstances. That circumstance being the merger of two airlines and their respective pilot seniority rosters. What has changed?

The threat of never seing a joint contract is no threat at all to the West.

The east list is not by DOH. As far as I know there is no intention by uspa to restore the DOH to the empire pilots, and a lawsuit was filed when they passed the list, by east pilots who are on the east list below their original airline DOH.

If you win the "snapback" issue, will the company have to pay you? I mean after all this is just arbitration. Can't the company just change its name and wash its hands of any further obligation to you? Or maybe they will sue or fire a small group of your pilots (about 18 of them), and attempt to use them as leverage for you to cave into their demands. Maybe they will hire an expensive lawyer to muck up the implementation of your "snapback" for years to come. They can certainly afford to litigate for years with your continued help in subsidizing the operation with LOA93 wages (about $50,000 a year per pilot).

Maybe its just me, but I don't see you getting an extra penny without a joint contract.
