Legal Update - Judge Silver Sets New Reply Brief Deadline

Judge Silver yesterday (March 8) entered an order directing that all parties may file reply briefs in the Phoenix Declaratory Judgment action no later than March 19 and that the reply briefs may be no more than 15 pages. The Phoenix Declaratory Judgment action involves the allegation by US Airways that the Court should enter an order clarifying whether USAPA is or is not required to adhere to the results of ALPA Merger Policy, i.e., the Nicolau Award. Yesterday's procedural order came as a result of an attempt by US Airways and the West Pilot Class to deny USAPA the right to file a reply brief answering arguments raised by US Airways and the West Pilot Class in legal briefs they filed on February 21.
The Local Rules of the United States District Court for the District of Arizona, where the case is pending, provide for the routine filing of reply briefs, and in a previous order, Judge Silver ordered that "all replies [shall be] no more than 15 pages." (Doc. 147) As reported in the previous Legal Update (February 22), under the Local Rules reply briefs were due to be filed on March 12. Nevertheless, US Airways and the West Pilot Class yesterday (March 8) notified USAPA's counsel that they did not believe that Judge Silver intended to allow the filing of reply briefs, and then in a conference call told Judge Silver's clerk that they opposed the filing of reply briefs. The order setting March 19 as the deadline for filing reply briefs was issued late yesterday following the conference call.
The order reads in its entirety: "IT IS ORDERED the parties shall file replies of no more than 15 pages in support of their motions for summary judgment no later than 3/19/2012. Signed by Chief Judge Roslyn O. Silver on 3/7/2012. This is a TEXT ENTRY ONLY. There is no PDF document associated with this entry. (ROS)"

I agree.

But I would add that the only thing that will make these junior, greedy.....Mesa oriented bastards happy is if you had an anurism and gave up you #1 seat on the 767. They have no decency, compassion, or respect for those who have invested their lives in this career. Someday they will senior, but still working under Parker under slave wages compared to the rest of the industry. They have no clue as to what it's like to have a decent job and have been trained to accept that they are a lesser pilot. We have seen better days and they have never been there.

I expect you guys to attack our previous airline, but you don't have a clue about happiness and being proud of your airline and your job.....you just haven't been there, thus your cannibalistic attitudes.

I agree.

Hey boo boo. You may not realize this as your senility takes hold, but we've got guys here who have walked the line at Eastern. Some have probably seen more crap than you.

So drop your attitude and quit your crying. We're getting tired of hearing it.

You want respect, act like you deserve it.

No one - not us, the company, pilots at OALs respect you because you don't deserve it.

You tried to recoup your miserable careers at our expense and we shot you down. Now all you do is cry about how unfair life is. Life sucks and you deserve what you have.

When was the vote by the PI pilots - after all, I said that the pilots didn't have anything to do with it didn't I? There wasn't even discussion of the issue at any GSO LEC meetings - were you there?

No Jim, I was in Utica! Please stop trying to insult me and the rest of the EMPIRE Pilots with your lame excuses. ALPA, more specifically, Piedmont ALPA was and is responsible for stapling the EMPIRE PILOTS, not to the bottom of the seniority list, but BELOW THE BOTTOM!!!!!

Do we really have to rehash this again? If so I will drag out the rest of the BS you EF'd us with
