I liken the experience with Wake to the successful test at White Sands, code named "Trinity." USAPA's shrieks of victory post 9th would be no different than the Japs claiming victory that first successful atom bomb test didn't harm one Jap. We tested our DFR before a jury and it worked magnificently. We got a whole storeroom full of evidence, cataloged and tabbed, ready for the next run.
 
Sir, in your post in the previous pages you asked me why the Empire Pilots can not get date of hire now using USAPA's help. I posted a link to an appellate decision that rendered the Empire Pilots ability to gain in seniority today moot, thanks to the "esteemed" Airline Pilots Association.

Now you are going off to a different area of argument regarding the West vs USAPA. Your group, including the lame law firm that you spent millions of dollars on, can not focus. This is why your legal gluetus maximus has been handed to you in a court of law thus far.

If you dont mind I would like for you to clarify your comment for me please. I understand your emotional tone and would ask that you only answer the question of how so? I look at that disgraceful Rico case usapa filed and lost on twice. I look at the DFR claim that was won then sent back with some very strong words of advice for usapa for which I fully expect them to ignore. I just dont understand the claim you made of our being represented by a "lame" law firm and how we have been getting out butts kicked so please do tell.

You use the e word, emotional word, sound bite from ALPA and the West. Excuse me sir, to paraphrase the war on drugs for my analogy for the rights of the East Pilots, I am going after the suppliers and not the users, I do not have time for your reply.

The ALPA supplier is Boeing Boy, the West is Aquagreen. The F/A is Bear 96. The company poster and Delta ALPA shill supplier has yet to be decided.

This is a compliment for the above respective shills, not intended to be an insult.

Ok I now see what it is with you, its just all emotion and no intellect. Here please allow me to aid you in your quest for some real knowledge regarding the law since you are obviously lacking in that area.

Your future is the NIC and allow me to tell you how.

Usaiways Declaratory Judgement, the court will tell usair that by law (RLA) they must negotiate with usapa as that much is a given. They will be further told and this is the meat so pay attention, you sigend a contact via transition agreement which binds you as well as the other parites to it until such time as you have a joint contract. Should you chose to breach that contract you will most likely be sued however that is not for the court to determine. Further we CAN NOT INDEMNIFY you against future law suits. Usairways now armed with the information needed to make an intelligent decision regarding this issue. The will not side with east when the cost of doing so the airline.

Usapa will NEVER be released for self help with 40% of its pilot group is fight the 60% as it appears to be majority vs minority and we all know how that ends as the 9th has already spoken on that issue even though you have chosen not to listen.

There will be no need for a DFR two as DOH will never be used for two reason first and foremost because the arguement of "its not fair" will never hold water in any court as it pertains to the arbitration. What usapa is attempting to do goes right to the heart of arbitrations in this country. I would expect at some point for the supreme court to get involved with this mess over arbitrations and bring to a close for good your arguement.

Now I wish you all the best and hope that at some point you stop cutting off your nose in spite of your face. It has been proven that you lose everyday and that you hold hostage your own captains as there is zero in this for them. It time to stop being childish and accept responsibility for your actions. DOH is something that you will never ever see and you will waste a boat load of time tring to get somethng that is never going to happen.

I like your analogy, but the decision from the 9th should be recognized in the proper context as a win for usapa. Not for any of the reasons usapa believes, but it saved them a lot all the same. Most notably, it put the immediate pending damages portion of the bifurcated trial to rest, and allowed them time to keep stalling the inevitable.

Unfortunately, they do not recognize what they did and did not win at the 9th. Cleary actually accused Parker of resurrecting the Addington trial,"after the 9th ruled in usapa's favor". He does not get that the 9th did not take away the nuke, they just gave us a more accurate fuse and hence a more reliable bomb to drop. If there is ever another detonation it will be on target and "unquestionably" triggered.

Really? Money well spent as you are still miles away from DOH, and your time is ticking. Time is something that I and most West pilots have a lot more of than you fellows on the East. Keep wasting it - I've got a lot more of it than you.

How's the pension investigation working out? How's three and half years and counting on LOA 93 working out for you? And finally: how many jury verdicts in you favor? Keep whistling past the graveyard pal.

Perhaps, who knows. Where I come from though, when you in the east go about addressing the issues in the manner you have, rolling over is simply out of the question.

I think we have already proven that you are as clueless as a stick of butter but be that as it may you have no case. Its not fair is not a valid defense. Now I know that you want and wish that you could just not honor that arbitration but you will. This is driving you all in the east just nuts but you will be in order via the NIC and if you can not stomach that then you need to quit and go elsewhere. DOH is never going to happen no matter how many times you lie to yourself and wish upon stars.

It is better to have a pension to be investigated, than not having a pension to be investigated.
That's similar to what Duane Woerth told us when he graced our presence to condescend toward us at a council meeting. He told us we needed an R in reference to our R&I comittee. And then of course whenever it came time to actually talk about getting the R, the talk turned to your no such and such airline. And you think ALPO slighted you?

Truth be told, I'd rather have an ethical and balanced usapa than ALPO ever again. Although now it looks unlikely to have either for the forseeable future.

Hell I spend twice that on my cell phone, probably spill that amount in Starbucks each month and make more than that if I sit in the PHX hold bay for 15 minutes.

We have already lost, but the Nic is the only list that will ever be the combined system seniority list at LCC.

Since there were only 987 names on your "backer" list, you need to at least double your number.

The Nic will never be in a contract. You can take that to the bank, when you go get another check to send in.

We live with DOH every day and our east attrition is just around the corner. My pension from the PBGC is going to be around $44,000 plus the wife has a PBGC pension also. Thanks for asking.

J. Freund told you guys that all the risk is on the west side......boy, was he right on the money. That Wye River send off really hurt you guys. Lets face it, you guys are younger and smarter.

LOA 93 is going to be just fine.........again, thanks for asking. It will be a game changer!
