Man you guys are pathetic. ALPA funding Leonidas? No....the reality is your worst nightmare. The reality is that West pilots are not like the bulk of the East. We look out for each other. Top of the seniority list Gold and Titanium same as the middle and the bottom.

You will never get DOH. A year from now you'll still be on your pathetic bankruptcy contract getting the same attrition as Nicolau gave you. Two years from now, same thing. Three years .... You just can't fix stupid.

No, the Nic ISN'T dead...the fact that you Union keeps repeating that over and over doesn't make it the truth. Also, if you are so confident that it will NEVER be ratified (and knowing the East, it probably won't), you guys have a lot of nerve blaming the company for stalling on contract negotiations. What do you care if the Company offers you sweet work rules and massive pay increases or not? Because it WILL include the Nic, you're going to vote it down anyway, right?
 


So let's get a Tentative Agreement and put it to the test. Will an "Industry Standard" with the Nicolau pass?

I think it would by a narrow margin.

Oh sorry, we can't achive a T/A because:

1) The Company is dragging it's feet. (USAPA Party Line-See latest unilaterally filed law suit by esteemed President Cleary.)

2) There can not be a T/A until Section 22 seniority dispute is resolved. (Company Line-see latest CLT Crew News)

Second verse, same as the first! Dude, we'll just let this run the court process all the way to the very end. Then one of us can cry in our milk, and hopefully one of us will know how to be a graceful winner. Until then, I'll enjoy my contract and you can enjoy yours.

Actually you are quite wrong. There is no integrated seniority list nor will there be one until you all are working under an single contract that incorporates one into it. As it stands, there are two lists the East and the West, and a third if you include the placement of new hires under your transition agreement.

Wrong, management contractually accepted and paid both MEC's for the Nic. list, seniority list part of the TA done and finished. Usapa proposes to renegotiate the finished and accepted list to benefit the east at the expense of the west, classic DFR and there is precedent case law in the 7th circuit that addresses this scenario and has been upheld in front of the supremes.

I would like to hear from USAPA supporters and those who support USAPA's so-called "Safety First" campaign what you think of USAPA's reknown Safety Expert Dr. Von Thaden. What usapa proposes is illegal, and has been upheld as being illegal in a different case, the 9th simply said not ripe because usapa's position is a proposal and therefore we can't be sure the final list will harm the west. Remember the litmus test here is not whether the Nic. or usapas list is more fair, the litmus test is whether usapas final list takes the wests seniority in favor of the easts, that has been proven to be illegal. BTW the dissenting judge on the 9th forecast this exact situation because the 9ths majority refused to look at the merits, including usapa cb&l's which mandate a doh list after the fact.

There is one integrated seniority list and it disputed by USAPA.
 
Jury selection in this trial began today. It should be interesting to watch.
