As far as what he was saying, and I know you were here for it, the overwhelming amount of East pilots were polled by the MEC and asked to give ALPA merger policy a chance. They did, and they also told them they would only vote for DOH with conditions and restrictions.
I know, I flew with Marshall Rogers both before and after the "award" and he was told the negotiating committee would be given a chance to come up with a solution but it's up to the rank and file to decide. They decided. Its DOH with conditions and restrictions.

The MC knew DOH was a losing strategy.

A tripartite agreement was entered into between the company, the east pilots (represented by ALPA) and the West pilots (represented by ALPA)
ALPA did not enter any agreements other than as the representative of and for the two distinct pilot groups.
usapa, by seeking election onto the property, did not enter into that agreement, but by winning the right to represent those two pilots groups, is bound by federal law to do just that, represent.
So get on with it usapa, represent the two groups who agreed to a final and binding arbitration process to resolve the internal union dispute. Can't do it can they? And why is that? Because they were formed and founded to renege on that arbitation and advance the interest of one of the groups they represent over another one of the groups they have the obligation to represent.
This was all explained to usapa in PHX prior to the election.
You will be sued and lose, because you are failing in you DFR.
Now, everyone seems to question my claim that damages started in 2008. What the heck do you people think the "pain" is in "pain of an unquestionably ripe DFR?" Do you all think that when usapa is held liable for a DFRII, that the "pain" is just going to be, usapa has to use the Nic, and sin no more? Hell no, there are 3 years and counting of extorted union dues for a complete lack of representation. There are out of seniority furloughs displacements for the intentional delay of a contract. usapa will get the "pain" in $$$$$ amounts, and it is not going to be cheap. "seniority is not for sale", what frickin losers!
Another thing. It was sooooo kind of Cleary to file the lawsuit against the company in NYC. What do you think the company is going to accuse usapa of doing? If the case does not just get dismissed as the norm with anything usapa legal comes up with, and the company actually goes after a verdict, usapa is done. Intentionally delaying contract negotiations and not negotiating in good faith to purposely force seperate ops is an even bigger DFR than simply not using the Nic as the "bargaining proposal" of the pilots they represent.

That is an easy question. That liability transfers to the teamsters. The new union takes any responsibilities and liabilities.
