Nope. Not gonna happen. Thats not what the judge was asked to provide as remedy. The judge was asked to refer to the NIC as a negotiated position... ergo to be a part of a negotiated TA, that we all get to vote on.

AWAAPA forgot to require the judge to tell me what my vote is supposed to be on the TA. Back to the drawing board. 🙄

Being involved in federal civil litigation against ALPA right now, I can say that your timeline is truly fantasy. Our suit was filed in late 2003. We actually spent one full year between a court hearing and the judge uttering a word about our case. It's 5 years now, and the end is still nowhere in sight.

The federal courts are backlogged years for hearing civil cases, and each day the backlog grows as the federal benches are seriously understaffed. The only way this case will be resolved quickly is if the judge simply dismisses. At that's probably what will happen anyway.

Your Company leaders in Tempe will not even entertain the idea of re-ordering the seniority list with the "East" fantasy of conditions and restrictions (ie DOH) while this matter is being litigated. That is SOP in American business. That fact, in and of itself neuters USAPA. So if it goes on as long as you say...fine. Goal achieved either way. Then, with each passing year, USAPAs empty promises and failures will just be that much more magnified. Then what? No Contract because of the hindsight written CB&Ls? Dual ratification is still alive and well in the TA. What's USAPAs plan with that? Ignore it? Good Luck. How long will guys put up with LOA 93?

USAPA painted all of you into a corner. They went "all in" over DOH and it's now tied up in two class action lawsuits. DOH is DOA. USAPA has spent a Grand Total of 3 hours attempting to "represent" the West, (youtube). Even in that paltry, pathetic amount of time, it was stated by your brain trust that in fact, There was no "plan B". (I guess they got that from Gangwal). Great. No Plan B. Plan A is crucified in Federal Court. Now what? Even if the case gets dismissed, it can always be re-filed...just like the frivolous lawsuit against the West guys. This can go on as long as the whim of the West cares to.

Would you mind pointing out which a/c and position you are talking about that results in such a disparity?

If you are bugged about it, do something. Certainly ALPA wasn't going to do anything, not without strings that would actually result in pay cuts, for east pilots (Yeah, we are "giving" your job a $40 per hour increase, too bad you won't be able to hold that position for now ever again).

Why do you make this stuff up? What do you know about RLA and state courts? And where is this reference to Freund you guys keep mentioning. Can you at least provide a link to it, or did you make this up too?

The clock will not run until the Complaint has been served and the docket did not reflect that when I clicked on that link. Then an Answer (to the Complaint) is due within 20 days after it has been served. At that point the Court will set dates and the docket will begin to fill.

No. I'm not "admitting" that the West is OK with ignoring the fact that the NIC happened as a product of a very expensive, mutually agreed upon process. Far from it. I'm just illustrating the obvious chink in the armour when I point out that USAPAs CB&Ls, and all of their pie in the sky campaign promises just got buried by the company for the foreseeable future as a result of the West's Class Action Suit. No DOH, No Contract, No Raise for you. No way for Bradford et.al to even approach fulfilling their blustery, delusional assertions that they've got DOH as a "slam dunk", (as S.B. put it). You see, I KNOW your management will not discuss re-constructing a seniority list to appease the majority. I also KNOW that the NIC is alive and well. That's where you and I differ...you just hold onto hope. Where has that gotten you in your career?

Do you read what you type? Your OK with years of litigation. All then remains status quo which East never had a problem with. East desires no gain from West hence the fences provided in negotiation. West on the other hand wants (wanted ?) the windfall of St nic. Your logic is a bit puzzling.

I'm not a West Pilot. I don't work for US Air in any capacity. As far as the Parker meetings go, I'd say one of the few rational pilots you have handed Cleary his own ass when he tried to act like a tough guy with Parker. There's a reason that USAPA has no method for it's members to express their opinions in an uncensored forum. They control every iota of information. Lo and Behold, everything is coming up roses....sure.

Before you call me a liar about my work status I'll just say that I have access to all of your companies info and website...just like Seham has to the now sidelined AWAPPA boards. Suffice it to say, I'm informed.
