I'ld say the judges in our experience were all pretty good except for Wake and BuyMe, uh Bibee.  And Silver emulated a brat as best she could.  But certainly they didn't create a Constitutional Crisis.   😀   

 
Pretty much my thinking as well. We're all of us just human beings and will all forever be subject to the attendent flaws and foibles of our species. "On the most exhalted throne on earth we are seated on nothing more than our own arse." That's no inherent reason to condemn any system.

In the next paragraph of her ruling, Silver declares USAPA's victory to be "Pyrrhic" and declares that USAPA will quickly be replaced and "will no longer be entitled to participate in the seniority integration proceedings." She said, "The court has no doubt that - as is USAPA's consistent practice - USAPA will change its position when it needs to do so to fit its hard and unyielding views on seniority" and will argue that it ought to participate even if it is not certified.

"The court's patience with USAPA has run out," she wrote. "USAPA avoided liability on the DFR claim by the slimmest of margins and the court has serious doubts that USAPA will fairly and adequately represent all of its members while it remains a certified representative."

Food for thought, in reference to the eloquent speaker in the PHX crew news on "leet-e-gay shun". Assuming a number 600 of their 800 or so first officers that can all hold captain now in CLT.
If the arbs stapled the east under the west (doubtful) mr 600 of 800 would get full access to east attrition and looks to upgrade approximately 3 years after implementation whic is estimated as early 2017.....
Soo, we're talking about 2020.... Hired around 2003, yep, your read it right.....17 years.

You must naturally realize that this flies in the face of all accepted west "wisdom"...Perhaps it's past time to poll a few PHX philosophers and tribal shaman/soothsayers as to just when indeed "The nic will" (ever) "be crammed down your throats!"

So which term should truly be of most concern to all here?...."Pyrrhic" or "victory"? 😉 "Pyrrhic" serves only as an adjective there, while "victory" defines an actual event....Just sayin'....
 
Ponder that while "you'se" (and only the very most faithful cultists) contiunue to beat your hollow chests and shout "This is Sparta!"...and otherwise just stare blankly at the wall around PHX for likely at least the next couple of years.
 
Once again; to the both intelligent and decent pilots I've met from PHX: I mean not the slightest shred of offense towards any of you, and I'd wish circumstances otherwise than they are, but I've precious little use for your "spartan" punks.

Not to divert the thread for more than a moment here trader, but I'll have to strongly disagree with that, in that I feel our legal system's the very best yet seen on earth, and exists to adjudicate and enforce, but not to initially make the laws of the land. 

 
Do you enjoy being spied on without probable cause, having the IRS attack you because of your political activities, having your right to bear arms threatened, having Senators write laws that make it legal for them to insider trade?

Point taken "Jake", and we've most certainly NO argument there...but I must again reference the thought that it's not inherently the system, but rather some/many of the individual people improperly seated within it, whom, in anything even remotely approaching a perfectly "Just" society wouldn't ever be mistakenly trusted to so much as walk dogs around a park...at least without any actually adult supervision. Hell!...At present; we've even got a supposed "Secretary of State" that can't even ride a frikkin' bicycle without busting his own sorry arse, and a completely worthless little "Pimp-in-Chief" that was soundly beaten by literally a 10 year old girl in just bowling!
 
As utterly sickening as things have recently become; NO institution of humankind can ever be better than the the people maintaining it, and I'll still stick with having loving hope for America for now. Seasons change...unknowable future events often trigger change and our nation's Colors still fly, so no fat lady's yet sung.

They made the decision, and it was the wrong one, you should concentrate on getting over your fear of upgrading.

I am not even sure if that is correct, but you will have to take that up with Mr. Parker. Do you have a reference for your "part of the flying on every WB ... belongs to the West" statement? I see that bandied around quite a bit by the West pilots.
