What does footnote 12 say?    And the remainder of the order say?    I believe it says that USAPA must endorse the nic in seniority proceedings.....but Hmmmmmm....hasn't another decision been made the USAPA is not party to this since APA took over?     So we have a west com.   a east com..  and a AA com?        I think usapa is about to disband........who gives a **** anyways........10 yrs...we got that on top of you guys.........No bump no flush........you can't get our positions......thank you...

Based on that then I assume the Ninth's order falls the successor CBA (APA) to advocate for the NIC. That's even better for the process.

They don't have to. RLA is crystal clear about CBA's inheriting every single agreement from successor CBA's. Just because USAPA illegally ignored that aspect of the law doesn't change anything. The APA is bound by the Nic. After reading the 9ths ruling, the APA would be  insane to challenge them.

You can't get our position..no bump, no flush, whatever. That's like a looter running out of a store with the goods before the cops arrive. Eventually, thieves get caught and there are mechanisms in place to right a wrong.

To all former US Airways Pilots:

In light of today’s 9th Circuit Court of Appeals decision all future vacancy bids will be open to all US Airways Pilots.

Although the decision and accompanying orders technically only effect the ongoing seniority integration process, American Airlines in concert with The Allied Pilots Association have agreed that the right and just method for the filling of vacancies going forward in the former US Airways system should and shall be accomplished according to Section 24 of the former America West Airlines Collective Bargaining Agreement.
