The 9th is to be commended for theri impeccable timing as to throw you scabs for the biggest loop ever with no time to react. HA!!! This is so hysterical! yet another temper tantrum, another "take my ball and go home" moment. This time, under an order from the 9th, and directly infront of the Arbitration Panel.
 
Perfect. They get to see exactly what kind of criminal, untrustworthy, no ethics Pieces of Schitt you scabs are. Again. Perfect. The crazier the better!!!

Yessir! The walls are closing in and with Usaps voluntarily withdrawing it leaves the east represented by the west. The show is going on without them. I bet the west will argue Nicolau with conditions and restrictions to make the west pilots whole with the east. And there won't be an east opposition because they voluntarily withdrew- which is their right. The east doesn't have to participate if they do not want to. But the show is going on.

Read USAPA's letter (and contemplate exactly what it's effect is). The parties to the protocol agreement now have no recourse except to go to court seeking a compelled MB arbitration (which is exactly what USAPA did originally.. and it was the impetus for negotiating the Protocol Agreement.)

Once again the only way forward is the courts or negotiating. Square 1. The APA's tar baby. Union divided. Doug wins. PHX is holding aft stick, approaching a full stall.

Intermission has begun and the dancing bears are on stage. APA Legal is in a daze, but billing full speed ahead.

 
I have read the East MC letter.  Its effect is that they withdrew with no intent on returning.
 
I have also read USAPA President Bradford's letter.  Its effect is....well nobody gives a rats rear what an about to be bankrupt North Carolina LCC's head idiot in charge says or demands.
 
I have also read the Transition Agreement governing the America West acquisition of USAirways...seems all conditions of the TA have been met.

Here's my prediction: the APA arbitration satisfies the requirements of the MB legislation.
 
The fact that USAPA chooses not to participate doesn't mean MB isn't being followed.

Watch the 9th circuit court video, the Honorable Judge Bybee informed marty that all they could do for him is provide a rhetorical club, marty agreed with their assessment, they gave him that.
