And anyone expecting to have dramatic change of bid status after this is all over, they are a low information gullible lawyer target.

Anyone who expected the West would be denied a Merger Committee should not accuse others of being low information.

I thought the whole "we listened to the USAPA lawyers, we were duped!" lie why hypocritical, but I think the jabs at Judge Tashima might take the cake. After berating those that called Mr. Nicolau senile, we have a westie doing the same and the rest of the villiage piling on.

Did you guys know that Judge Tashima was a Marine in Korea? And he volunteered despite the fact that this country put him and his family in a Japanese internment camp during WWII? You think that event early in his life might help him develope a keen sense of fairness?  And unlike one of the majority opinion judges, I couldn't find anything about lawmakers wanting to impeach him.

His dissent is about 27 pages long, or about as long as the whole judgement from the Addington I appeal. It's clearly written and I didn't see any blatant errors like the majority had. But we know that the truth really doesn't matter, say something against the west and their jihad and you are scum.

You guys are a trip.

Ninth Circuit Judge Jay Bybee, who signed an infamous memo approving the Bush Administrations use of torture while he led the Department of Justices Office of Legal Counsel, received $3.4 million in free legal and consulting services to help him avoid accountability for his legally and morally indefensible memo. The lions share of this massive gift came from Latham & Watkins, a massive corporate law firm whose clients include Koch Industries, Bank of America, Goldman Sachs, ExxonMobil, and Phillip Morris:
Latham & Watkins Maureen Mahoney took on a major assignment when she agreed to represent Jay Bybee, a federal appellate judge who was accused of violating ethics rules for his work at the U.S. Department of Justice on so-called torture memos. Newly released records show just how big the assignment was. . . . Nearly all the assistance, $3,251,893, came from Los Angeles-based Latham, whose lawyers used to appear before Bybee in the courtrooms of the U.S. Court of Appeals for the 9th Circuit.
Its worth noting that Mahoney isnt just any big corporate law firm attorney, she is a former law clerk to then-Associate Justice William Rehnquist and is widely considered one of the top appellate litigators in the country. Although it is common and indeed admirable for attorneys of this caliber to provide pro bono services, those services are typically offered to the genuinely needy and not to powerful government officials who could resign their judgeship and immediately receive a job in private practice earning a high six or seven figure salary.

Why did your lawyers have different stories, depending on the audience?

From the 9th's ruling:
The USAPA Board of Pilot Representatives voted to approve the MOU on
January 4, 2013. Thereafter, the USAPA Negotiating Advisory Committee
embarked on a series of roadshow presentations designed to inform its pilots about
the MOU and urge their approval. USAPA, however, tailored its presentation to its
divided audiences. When presenting the MOU to the West Pilots, the USAPA
representative stated that the MOU was merely neutral with respect to seniority.
However, when speaking to East Pilots, the representative said that the MOU was
beneficial because, in effect, it confirmed that the Nicolau Award was dead. In a
written statement to pilots, USAPA confirmed that under the MOU, the Nicolau
Award was dead: West pilots should not vote in favor of the MOU because they
believe it will revive the Nicolau Award, and the East pilots should not vote
against it because they are concerned it will cause the Nicolau Award to be
implemented.

Your fake outrage is entertaining. You remained silent while Judge Bybee was under fire. That's convenient.

I don't know that they did present different stories. I only went to the CLT show, but if Symanski told east pilots the Nic was dead he lied to them. I was not told that.

Judge Bybee has a little history. Do you support calling Judge Tashima senile Mr. Integrity?

Anyone who thinks they will get a windfall big enough to push TJ out of the FO-but-still-eligible-and-afraid-to-upgrade-to-captain range is low information handicapped.

Anyone who forms a scab union to steal a windfall at their co-workers expense is surely not low information handicapped!  Quite the contrary, they are on the front lines of disinformation dissemination to the lemming scabs willing to follow.

I took his "senile" remark as a jab/pun/joke at the east for using the term to describe Nicolau, not an actual accusation of Tashima's mental health.

It was funny in that context and obviously WAAYYYY over your head!

But, then again, so is the whole why you are gonna lose the falsely inflated seniority position you think you have.

Well there you have it folks.

Arbitrator luthe9 has spoken and we can all just forget about those meetings in DCA in Sept.

Meanwhile back on planet Earth, his junior position will get him a "nice" place on the New American's pilot seniority list, commensurate with his Nic status and his low career earnings expectation.

Have I mentioned lately that the Nic is the only accepted system wide seniority list for all LCC pilots.  Never vacated by any court, and indeed upheld by the 9th.

Nobody cares, and frankly, many on the West do not care if the new east merger committee is actually bound by the 9th's ruling.  That would be the ultimate FU though.  Having a whole new committee set up, just to find out that the 9th meant what they said about "east pilot" (not just usapa) in their ruling, having to argue for the Nic in the SLI.

And yes I did read some typical trash update out of PHL about the new committee members.  Here is what I know.  They are all junior to me, on guy I believe is a very junior 3rd lister, and I am sure they are all peachy cool kids who are going to make fools of themselves with an overreaching proposal.

I really hope they fire up that python computer program thingy usapa used and try to make the case usapa did,,,,,,we will tear them to shreds, yet still get them their Nic seniority.
