Legacy American, USAirways, america west pilots arbitration panel statement:

BACKGROUND

"On Friday June 26, 2015, virtually the eve of the opening day of ISL arbitration hearings scheduled in accordance with collectively negotiated terms of the Protocol Agreement and Ground Rules, infra, the Court of Appeals for the Ninth Circuit issued its opinion in Addington, et al. v. US Airlines Pilot Association, et al., No. 14-15757 .

Because the Board concluded that issues raised by that decision and related communications from the Parties significantly compromised our ability to begin the scheduled hearings on June 29, we notified all parties as follows:

On behalf of the Panel, this is notification to all concerned that, after careful
consideration of the 9th Circuit decision of June 26 and related communications
from the Parties, the Panel will not convene the opening session of the hearing
when we meet with you on Monday morning, June 29."

Your thoughts please west pilots?

That you might be the most obtuse poster here, and that your perception of evading the product of the mutually agreed upon process is flawed in every way.  Don't worry, the court's get it.  The arbitration panel gets it.  Heck, even Mike Cleary got it:

“…The Arbitration Board conducts an evidentiary hearing, with witnesses, evidence and a stenographic transcript. The Board’s Opinion and Award are to be issued simultaneously, within 150 days following the PID, unless both pilot groups and ALPA’s President agree to an extension. The Merger Policy provides, “The Award of the Arbitration Board shall be final and binding on all parties to the arbitration and shall be defended by ALPA.” No ALPA seniority integration arbitration result has ever been set aside by the courts although some dissatisfied pilots have challenged the award before administrative agencies and the courts.”

What the arb panel got was a glimpse at the involvement of west pilots with certain legal venues. They were not happy at all with your eve of arb involvement. It changed nothing except the date.
Leaky, tell us what you have heard at your latest golf outing. Is the Nic still nicing?

The arbs are leading you to slaughter...kind of. They're letting you lead yourselves actually. If there's anything a group of Eastholes is proficient at its self destruction. Funny how you don't understand what's happening. Not surprising, just funny.

One of the four Leonidas LLC directors is apparently now employed as an American Airlines pilot;\

Having Kevin Horner associated in any way with this DFR only hurts the effort. How can he adequately meet the fiduciary requirements to fairly represent the class? Our sources have told us that Kevin Horner’s current union, the APA, is furious with him for his participation in a DFR suit against another union.

Keep up the good work you have no friends at the APA.

Yeah.  Anyone who takes a look at the upward movement of the east vs. west list over the last 10 years would certainly see how all those west pilots are jumping into wide-body left seats faster than they can be trained.  And those west new-hires who are getting captain bids before they are off probation really brings your point into focus, D**b S***t!

Ooooh.  Haven't seen that one in a few weeks!

So I was enjoying an evening beverage on my RON last night with my buddy.  The hotel pub was pretty quiet, but a couple of pilots strolled in.  We struck up a conversation, and found that these new patrons are SWAL.

After finding out that we were former AWA pilots, the Captain informed us that he was a 1999 hire at AAA but had been furloughed in late 2001.  He remarked that although he was out for a little while, he managed to secure employment at SWA in '04 (now a Captain).

He said that he had heard that the 9th had affirmed that the Nicolau List.  I said that was the gist, but that naturally USAPA was doing everything in their power to continue delaying/evading the Nicolau List.  I also shared USAPA's plan to quit the SLI process, change it's name, get a new committee and thus not be held to the 9th's / courts mandate.

He just shook his head, smiled and remarked how very lucky he was to not have to deal with such imbecility any further.  He chuckled, and stated that he in fact was recalled to the New US Airways in '06.  He thanked his lucky stars that he did no such thing, or gave such serious thought.  We adjourned, and he wished us all the best of luck on the SLI process with American Airlines.  A very nice and informed man.

Have a Great Day boys.

Here's another example of an arbitrator's perception:

In the matter of: Preliminary Arbitration Board APA/USAPA/AA (December 17, 2014)

ARBITRATOR JAVITS: All three lists. I guess the gravamen of the questions is are you then putting yourself in the place of Nicolau, are you the new Nicolau because you are proposing a list which may not reflect Nicolau's list? ….. And American pilots. And, therefore, you're making a proposal, which may be different than what Nicolau had in mind
and issued back in '07.

MR. FREUND (in closing):As the Chairman put it so nicely in his questioning of Jess Pauley, what the US -- what the East Committee, the US Airways Committee, the USAPA Committee, call it what you want, what it wants to do is to put itself in the place of George Nicolau and redo what George did in 2007.

Interesting anecdote. I am glad that things worked out for him. Things usually do.

Captain at SWA. Nice. I may have flown with him when he was a new hire at AAA.

A 1999 AAA hire with a 767 captain bid is in training right now with LUS.  His training F/O, with whom I had flown with on the 330 a while ago, is a 30 year-old 2012 hire. Great guy also and well informed.

I am glad that things are working out for everyone. I wonder how long that SWA captain will have before he can get a 767, 330 or even a 777 or 787 bid? The 30 year-old 2012 hire is certainly in the catbird seat right now. He would have had a line in the summer but may go back to reserve this winter, unfortunately. Attrition is a wonderful thing, however. We've waited for years for the current retirements.

Yea, you keep saying that and pulling out the SAME crusty old video's. Why don't you pull out a video that shows a real RAY of sunshine?

I'm commuting home now on AA steel. I'll be sure to share the laminated copy of the Anderson letter. It's always good for a laugh.

Have a great day Clax.
