Thanks. I wasn't quoting the 9th, just simply point out that they made clear that USAPA the CBA had discriminated against the west by not advocating for the NIC, which if USAPA was still. CBA would be a violation of their DFR. So if USAPA not advocating for the NIC was a DFR when fully ripe, then the company would have been liable for collusion if they had also set aside the results of the binding arbitration award as controlled by the TA.Phoenix said:You usually are level headed and precise with your words (and post infrequently). Not so this time. No where did the 9th say what you just said. The reality is that the 9th stopped short of requiring anybody to ever use the Nic for anything at all, ever. It is the most unremarkable "win".
DUI never gave a rats patoot about anything except more profits and the Nic is just one more item in a long list of levers that enable the real winners to buy higher, wider, and longer yachts (i.e. Goldfish, steeped in self-pity and self-righteousness, notwithstanding).

Discrimination was Bybee's choice of words. I just pulled in from his majority opinion text.EastUS1 said:So then: "Nic lives matter!"....? You disappoint with useage of the terms "discriminated against", as if you're somehow part of a long-nobly-suffering, tortured and abused "minority". The net goal of the west's nic crusade was to place your brand hew hires ahead of people that'd actually worked even 16-17 full years already, and to see the bulk of you usurp at least a whole decade of your "fellow" pilots' worked lives.

That's funny. Like you think you have some sort of control.luvthe9 said:We will never let that happen.

He and the other two pilots asked about the seniority battle with the former US Air pilots was going. ....
All three shook their heads.
We talked further about the reversal of Judge Silver’s ruling, and I offered to show them “Capt. James Anderson’s” little manifesto that was entered into the record. All three read the 3.5 page mandate, ........
They shook their heads, and laughed several times.
The mention that they “were and still are the Sully’s of aviation” was particularly funny to one reader. It turns out that his son & daughter-in-law were on that flight.
...and then his alarm went off, he woke up with a start, and realized he was just on the road in another lousy Crowne Plaza... He had been dreaming to compensate.EastUS1 said:This is simply too good to pass up. 😉
We must first suppose that any and all pilots everywhere are just dying to hear petty details of whatever's going on with a seniority issue far removed from their own airlines and personal lives..? Umm...OK then.
"All three shook their heads." Was that done as a collective chorus, or did they take turns so you could better confirm their body language?
"We talked further about the reversal of Judge Silvers ruling, and I offered to show them Capt. James Andersons little manifesto".... "All three read the 3.5 page mandate,.." Seriously? They again ".. shook their heads, and laughed several times." Umm...OK, once again. I mean, after all; who wouldn't be raptly fascinated just by "Judge Silvers ruling" alone during a ground stop? Sigh...It must have seemed very lucky indeed for them to have encountered you during an otherwise potentially relaxing period. 😉
"The mention that they were and still are the Sullys of aviation was particularly funny to one reader. It turns out that his son & daughter-in-law were on that flight." Um hmm. I can't speak for anyone else, but I'm unable to imagine that had I loved ones on FLT1549 that I would find anything the least bit "funny" about it at all, but rather be extremely grateful to God that they had lived, but that's just my thinking.
Your whole "imaginary friends" nonsense has gotten downright pathetic.
What's funny is that every time you post, why more and people somehow agree with you !cactusboy53 said:

All three shook their heads. . USAPA - EPIC FAIL.
