1. I believe that Plaintiffs’ breach of the duty of fair representation claim should be dismissed as moot. I, thus, would not reach the merits of that claim.
2. If we do reach the merits, I disagree with the majority’s determination that USAPA breached its duty of fair representation.
3. Moreover, even assuming USAPA breached its duty of fair representation, the misdirected injunction the majority imposes is erroneous and an abuse of (judicial) discretion...

Sixth.... the ripeness issue here is evenly split with two judges on each side....  Given the balance of opinion on both sides and the quality of the opinions written by the district court (Silver) and Judge Bybee, this matter surely merits further consideration. 
 
 
 
This was an actual argument submitted by AOL (used to argue for an en banc hearing in Addington I).   Yes, their lawyer actually said that Silver and Bybee counted as two judges in favor of ripeness and Tashima and Graber counted as the two judges that found no ripeness.... so therefore the matter of ripeness had to be re-heard, by the full court.   
 
Liberty Ties paid for that.  
 
The point is this... The Westies hope that there will be no en banc hearing because statistically so few are granted (and their denial in Addington 1 is an example).  
 
But en banc consideration is not a matter of statistics.  Each case turns on its own merits (and obviously politics at that level, as one cynic has remarked "Lady Justice is blindfolded so she doesn't have to look you in the eye when she stabs you.")
 
Tashima's opinion is a bit more sophisticated than counting votes across multiple courts (Liberty Tie Logic).   We shall see what we can see.  We will not see what we cannot.

I can't speak for anyone else, but I'm unable to imagine that had I loved ones on FLT1549 that I would find anything the least bit "funny" about it at all, but rather be extremely grateful to God that they had lived, but that's just my thinking.

No melt down, Liar. I'm going home a couple days early for a MX hick up. Pay protected. ..do you guys get that now? I sure hope so. It would be unfair otherwise.

We in the east get something much better. Because there is so much training and movement I get trips bought, more than one a month sometimes. Do you guys get that too? Oh, never mind, I forgot there is no movement  in the fishbowl.

You have been saying that for 8 years now. What we've got is better than a 10 year fence, now you have to make the case for advancing yourselves to the 10K LAA pilots. Your boy Fruend better have some cute dancing shoes on with the arb board, he is going to need more moves than Michael Jackson.

And I'll say it for 8 more, icehole. I continue in the defense of our pilot group (you know, like FALSE RICO charges ), and our seniority list process that we agreed to. I'm doing it for Capt. David Odell. Have a great night "sir".
