For years the west has praised the supremacy and inestimable wisdom of arbitrators. Now strangely they are seeking Silver's inestimable wisdom to override the MB Arbs autonomy. What could possibly go wrong?

This arbitration and it's Arbitrators are subservient to a Federal Judge and other Federal Labor Laws. The Company, the APA, and the Arbitration Panel will damn well do WHATEVER Silver orders. You guys thought you'd simply hide behind USAPA, violate every Law you could in the futile, Jihadi Quest for DOH, then dump the sham organization and pretend it wasn't you after you got your way evading any consequences.  Didn't quite work out that way did it?
 
MB has never been tested. So far as it's concerned with this merger, it doesn't look anything like you assumed it would. Where's USAPA? Why aren't they still in there as the sole voice of both East and West pilots? Didn't you ASSUME that the Bargaining Agent for both parties would retain their full autonomy through out this whole MB process?
 
Ooops. Wrong. In fact, so far, this Arbitration doesn't seem to have any relationship at all to the MB statute as it may have been intended. See, Federal Judges change things as circumstances warrant. USAPA was nothing but organized crime and aside from that Senile Dipsh*t Tashmia, everybody fully understood that. Funny that a Jury of 12 people, all of whom have no relationship to aviation, can unanimously understand exactly what USAPA is in under 90 minutes, but it takes the Federal Court system 8 years and millions and millions of dollars. Funny how that works. Funny how all that money ended up in that very system isn't it?
 
Anyway, here we are. ALPA didn't protect you from the Nic. USAPA sure as hell didn't protect you from the Nic. The APA isn't going to protect you either. This Arbitration panel, under MB, will refuse as well. The only ones who have ever said the Nic "wasn't fair" are you guys. I hope 5 extra years on LOA93 was worth the temper tantrum. But look at the bright side...at least you're not one of the 14 Idiots whose lives are going to be utterly ruined over this. Karma is calling those 14 rubes and they're going to take all of it on your behalf.

As I posted a week ago, all the West needs is for the APA to come through and they did.  By supporting a new east MC independent of uscaba, the APA has now inherited the Nic, and is on the hook for DFR from the West.
 
Who wants to bet the nAAtive MC comes to the table with a Nic based proposal?

in 2027, when you are still junior to the few remaining West pilots, think back to the upcoming arbitration, and get really pissed at the new east MC that will withdraw from the process upon Silver's ruling.
 
Then think again and realize...shiit, we should have taken the Nic at Wye.

Can you please tell us again (precisely) what the consequences are?
 
If you want to see how "fair and equitable" works you should pay attention to the MB Arbs....
 
Watch carefully... When the COURTS denied the West participation under MB the MB Arbs didn't sit idly by, but instead decided that the West should have a committee... Then when the COURTS jumped in and disrupted the STATUS QOU, established by the MB Arbs, the BOA responded by reestablishing three committees.
