"We thus remand this case with
instructions to the district court to enter an order enjoining USAPA

participating in the McCaskill-Bond seniority integration proceedings, including
any seniority-related discussions leading up to those proceedings, except to the
extent that USAPA advocates the Nicolau Award.12 See Bernard, 873 F.2d at

You never saw the quote above, from the 9th circuit in its non dicta remedy portion,

I'm familiar. It's not a trait I'd be boasting about. It speaks volumes of your character.

And...umm...not to be excessively cruel here, but exactly what witnesses/references might you be at all willing to offer up as to the true nature of your undoubtedly "heroic" and "noble" personal "character"?....Besides "This is Sparta!"and perhaps even an "Integrity Matters" T-shirt of course? 😉 Other than claimed "cactus18 bling" and even an intimidating "varsity letter jacket" (redeemable as at all "valuable" only inside Fantasyland)..well..I'll confess I'm as yet wholly underwhelmed. Sorry kid, but I don't make up the rules, and "it is what it is" in this world of ours....and "you'se" kids just ain't all that much, regardless of what you might imagine your "Magic Mirror" ever tells you otherwise.

Per: "It's not a trait I'd be boasting about."? Fair enough. You've both now the floor and my rapt attention; just what personal "trait" or actual life accomplishment(s) do you feel best suits "you'se" to properly boast about at all? Hint: Trying to personally usurp and wholly disrespect the actually EARNED worked-years of other human beings hardly confers any "valor"-soaked and "battle"-proven "knight"-hood....nor even make of you "dire wolves" or "lords and ladies" of any sort...And it really doesn't matter how many T-shirts and ties you kids print up to pretend otherwise. 😉

The ignorance, lack of personal responsibility to form opinions by fact finding and the herding instinct shown on posts on page 827 by west pilots, confirms the Anderson letter findings.

Got a question for EastUS and Phoenix.  How much does "supreme confidence" cost?
LMAO!!!

I can't speak to that without your accepting the flying wager, at which time you can feel perfectly free to directly advance both the fullest extent of your infantile arrogance and undoubtedly vast cash reserves to your heart's content princess....So?...No?...Not even a further shout of "This is Sparta!" and at least the waving of a "varsity letter jacket" even? Really? Sigh....What a pitifully boring bunch "you'se" mighty "spartans" are.

"How much does "supreme confidence" cost?" Well, I don't really know for sure, so why don't you simply show us all? 😉

P.S. failing the above, as "you'se" (from over 8 years now) obviously will; umm...perhaps yet another "T-Minus" countdown clock, once again set to forecast the impending doom of the evil east might serve to offer up yet some more laughs?...No, to even that anymore?

Thanks for the always-dependable laughs kids. Did I say "kids"?....I naturally meant "valor"-soaked "soldiers"/"knights" (and perhaps even "dire wolves!") in the purely self-styled, pwecious widdle "army" of leo-whatever of course. 😉

Grow Up.

You are busy spinning.  I am sure you want to take on one of my insights from the 9th circuit court findings as it applies to the District Court actions.

I am scared and hope you do not want to take me on.  (sarcasm)

Speaking of "a miss", little "Miss PHX": EastUS1, on 07 Sept 2015 - 4:35 PM, said:
cactus"boy"53: "I could fly out-fly you with one eye tied behind my back,...I challenge you to ....oh wait..."

Eastus1: "oh wait"?

Thanks for the always-dependable laughs, mighty-widdle "spartan"...

Indeed. Such AWAsome sorts of Fantasyland's finest self-styled "soldiers" naturally haunt one even one's very dreams! 😉

What is your bidding power starting when USAPA was voted in and the present?

Let me help you, stagnant.

Umm...Should we now properly concern ourselves with the threat of yet another "varsity letter jacket"?...Perhaps this time even claimed from actual Little League "heroics"? 😉

About as powerful as your bid with the nearly DEAD US Air in May 2005.  Lucky for you America West Holdings acquired US Air.  That's not a rumor, it is a fact.  Facts are funny things.  Truth is a funny thing.  Integrity is a serious thing.  Persecuting a bunch of pilots in the hope that you can BREAK them is a VERY BAD thing, and most assuredly ill advised.  BTW...You are forgiven, but one has to be repentant first (It really doesn't sound like you're in that boat).

One of my favorites:

From “A Conversation with an Attorney” - between Bradford &  Chris Katzenbach of Katzenbach and Khitikan, a labor law firm (Chris Katzenbach point):  “Don't give the other side a large body of evidence that the sole reason for the new union is to abrogate an arbitration, the Nicolau award, that in the opinions of most judges, should be allowed to stand due to no gross negligence or fraud.”

This in response to Bradford saying the following:  “I next specifically asked him about the formation of a new bargaining agent as an avenue of advance to get around this award…”

And another that may well be germane:

“….The Court’s patience with USAPA has run out.  USAPA avoided liability on the DFR claim by the slimmest of margins and the Court has serious doubts that USAPA will fairly and adequately represent all of its members while it remains a certified representative.  But all the Court can do at this stage is implore USAPA to, in the words of CAB, “make every effort to see that [the West Pilots’] are given extensive consideration, and that their interests are fairly and fully represented” during seniority integration…”

Judge Roslyn O. Silver, Chief United States District Judge

Case 2:13-cv-00471-ROS   Document 298   Filed 01/10/14

FYI:  This is the case that the 9th JUST returned to Judge Silver.  Gee....I wonder what she's going to say to the DEFENDANTS?

And while I'm posting....

“Actually, it is USAPA that is needlessly delaying the resolution of the seniority dispute and jeopardizing the enforceability of the agreement the parties are able to reach. …….The arbitrator’s decision was to be final and binding on both pilot groups and was to be accepted by the Company so long as certain conditions were met.  The Nicolau Award has resulted in four years of litigation including a trial in federal court and jury verdict fining USAPA’s proposal for a non-Nicolau list to constitute an unlawful breach of the union’s duty of fair representation….”
