We fought and got a committee who is going to present the Nic so you have 2 committees vs yours and a previous arbitration as powerful evidence of a fair result. So, you get your seat at the table, you don't get to storm out or call foul. I'd start worrying about how that committee of yours is going to do as the process moves along.

Oh shut the F-up. It was your group who formed a scab union to evade a process. You did not get a win, you got handed a participation trophy by Silver which is not much of an accomplishment. So what, we go into arbitration Ucrapa was put in a box by Leonidas and buried. Jeff Freund is a far better attorney than anyone you bring to the table. I'm glad we waked from Wye River, we don't play with liars and cheats we make their lives miserable. Hint: That case in NC.

So AAPSIC proposes to use the Nic, yet you guys are better off with the East proposal. Hmmm. Anyone out West remember your favorite word "pyrrhic"?

No. We are better off with the West proposal. Btw, whatever happened to that DOH proposal which Ucrapa promised?
 
 
The West was ten yards short of the end zone and spiked the ball, on national live TV. In a way you can't blame the West entirely, as it was Wake, Sliver, and Buyme that cheered the West on. All three judges kept prematurely screaming touchdown.

The BOA arbs are the referees. MB is the rule book. Fair and equitable it will be.
 
The three lists in the protocol agreement will not be shuffled.

The fourth list posted on Cactuspilot.com will receive its due weight in the context of a fair and equitable SLI methodology... In other words of the four lists it will be the only one shuffled.

Roslyn O. Silver is a federal judge for the United States District Court for the District of Arizona. She joined the court in 1994 after being nominated by President Bill Clinton.[1] Silver took senior status on September 3, 2013.

Neil Vincent Wake is a federal judge for the United States District Court for the District of Arizona. He joined the court in 2004 after being nominated by President George W. Bush.[1]

Clinton appointee above, why am I not surprised?

All impressive resumés. They should have known better and played inside their own sandbox. The courts never had the authority to rewrite contracts nor the power to impose bargaining proposals. The judges were zealous yet impotent. Tashima was the only one who left with his head up and his wrist unslapped.

How fitting that in the end they all bowed to Tashima's superior intellect, integrity, and respect for the law (Silver had the last word and paid homage to Tashima's argument in her final order of the matter).

The BOA reigns. It's what everyone agreed to. Integrity matters.

You're damn right integrity matters so what's your excuse? Raised as a spoiled brat? Handed everything in your life? When Dad said no, you went tugging on Mommy's dress?

They're over on the C&R's crying about the AAPSIC's proposal. Whaaaa :lol:

There is no way they are going to change it with a huge DFR target on their backs. The Natives are trying to explain but the brats keep tugging.

Silver cited and leveraged numerous arguments made by Tashima in her order. Over and over she sided with the dissent. She made it clear there was no sense in even having an injunction anymore. She pointed our that not only the three judge panel knew this but also the full ninth court knew it as well.

The only reason she issued her impotent order was to satisfy the ninth (exactly as they mandated) and to laud Tashima. Integrity matters.

The courts have now separated all the groups and put them back at square one. This is the do over.
