What?! You spent a decade and millions of dollars begging any and all courts to make the use of the Nic mandatory, and now that the courts clearly will never say that you take consolation that the courts decline to say "the Nic cannot be used." (Even though no one ever asked the courts to say that).

You guys were easy pickings for Marty. He should almost feel guilty about how easy you were.

I'm reading the order as we are having this little chat. Did the arbs say the Nic would not be considered? The arbitrators are on record stating what? 😉

The panel is well-aware of the history between the East and West
Pilots and, in fact, the panel has made clear that the Nicolau Award will receive the
appropriate amount of weight regardless of the positions put forth by the various merger
committees. That is, the arbitrators are on record as stating it will give the Nicolau
Award the weight we believe it is entitled to receive in the context of a particular
seniority integration methodology that we utilize to develop a fair and equitable
integrated list. (Doc. 322-6 at 19).

I'm being realistic about the fact that the Nic is still there it lives in the AA list and you are the one celebrating pyrrhic-ly.

You just celebrated the Nic's status as a proposal (USAPA told you Nic is a proposal for ten years!).

You conceded USAPA's founding premise! You ARE the show!

I propose you will have to live with the next proposal and won't get to revive USAPA to evade the binding proposal. 😉

The Proposal Recognizes The Nicolau Award, And Properly
Places The Burden Of Rationalizing The West Pilots Expectations
On The East Pilots

As discussed above, as of December 9, 2013, the East and West Pilots were working in
separate operations under separate seniority lists, with distinct pre-merger equities and career
expectations; and the Protocol Agreement contemplates that the ISL will be constructed from the three
separate seniority lists in effect as of that date. However, the AAPSIC recognizes the West Pilots
claim to the Nicolau Award; and that, under the circumstances, the relative placement of the East and
West Pilots on the ISL should be based on the Nicolau Award.
 
Something to keep in mind now that the East Merger Committee and the BOA are clearly not bound by the NIC, things could get better for one part of the seniority list while they could clearly get worse for the other. Example might be consideration for the return of furloughed pilots before and shortly after the NIC being presented on May 1, 2007 while at the same time erasing the 517 NIC placed at the top.
 
You never know what a third party will do once you've turned over control to them...

Someone get Claxon to put the list up of failed West pilot threats.

The question is, who will be covered by the injunction?
 
On my give a shot meter, it is only registering about a 2 out of ten.  
 
Frankly, the east MC proposal is so laughable, it is gonna be summarily dismissed.
 
Now, there is of course the matter of legal fees.  Very interested in what she says there!
 
Once the BOA starts, um...nobody cares whether the east tries to delay, it will continue without you..  If the BOA grants more delay they have harmed the other parties.
DUH!

Enjoy your perceived victory. Keep in mind that Judge Silver was overruled by the 9th and her order does nothing to change that fact. In addition, the AAPSIC has come out in support of the Nicolau. We fought and got a committee who is going to present the Nic so you have 2 committees vs yours and a previous arbitration as powerful evidence of a fair result. So, you get your seat at the table, you don't get to storm out or call foul. I'd start worrying about how that committee of yours is going to do as the process moves along.
