One of Mr. Jeffry Freunds quote below in his opening;
“At the end of the day, we have all been
round the barn with each other for quite some time,
and we're all just a bunch of labor lawyers and
arbitrators trying to sort through a problem.
So although we're sitting in these very
formal settings, this I think of as an informal
exercise to try to get to a correct solution.
So  I'll try to maintain the appropriate
deference

to the three of you,      (MB SLI BOA)

and I don't mean
anything less than that if I, from time to time,
call you Ira rather than Mr. Jaffe.”
ARBITRATOR JAFFE: That's fine.”
Frankly Mr. Freund, Chutzpah.
Freund and his schmoozing.........

It was kinda creepy how much time it took for Freund to pretend the BOA and him were all old pals on a first name basis.
Well jeff said I will call you Ira and you call me jeff.

Next week the BOA will get together with jeff and say can we be "Frank", ie: no nic.

The first objective fact is that there were three seniority lists in effect as of December 9, 2013. The American list, the East list, and the West list.

That is recited -- that is recited in paragraph 2.b of the Protocol Agreement, which is Joint Exhibit 10.

The West Committee doesn't like that fact. The West Committee wants you to act as if the Nicolau Award was in place at that time, credit the West pilots with virtual jobs they didn't have and virtual career expectations that they didn't have as if that was actually the case.

It wasn't the case.

The Nicolau Award wasn't in place in December 8, 2013. The East and West pilots were under separate seniority lists with separate collective bargaining agreements in separate operations.

That is a fact. It's stubborn, but it's a fact.

So it's -- so to be clear, if the West pilots ultimately achieve the Nicolau Award, it will be because of this merger and this arbitration.

The West has doubled down on their emotionalism and added to it simple "incoherence".

Is the EPSIC under oath? It's rather remarkable how little they (pretend) to understand about the Nicolau Award. Do they think George Nicolau's protoge's (aka the BOA) are as stupid as their reps are? Nice work girls. Please, Keep it up. Nothing like Bald face liars in a room filled with fully informed parties. Didn't think you could dig yourselves a hole deeper than you dug yourselves before Nicolau? See you in China Idiots.

Freund seems a bit testy, with nerves on edge... He is a perfect match for his clients!! 😀

MR. KENNEDY: I'm sorry. Does that mean that Mr. Devicq is not testifying this week?
MR. FREUND: I just think it's a -- I mean, if there's time to put him on, we'll put him on. But I'm just thinking about the way the world is likely to work.
MR. KENNEDY: I'm not trying to jerk you around. I'm just trying to understand.
MR. FREUND: Yeah. You'll tell me when you're trying to jerk me around. Is that it?

First we had a 3rd lister who had no idea that he was hired at LCC and not LCC "east" and was contractually hired junior to all West and east pilots at LCC.

Then we had an MDA pilot who had no idea that the MDA pilots lost a court case and an arbitration , both saying they were not employed for AA mainline, yet he contends he was never furloughed from mainline.

And, last we had a committee chairman who had no idea the company accepted the Nicolau list in 2007, yet he received a letter in his company mail file and there was a read file and many company postings at the time of Mr. Parker's letter stating that fact.  Also, ALPA updates galore on the topic, as well as the ensuing scab hissy fits, all surrounding the company's acceptance of the Nic.

Entire east committee perjured themselves.  Way to go guys.....!!

You should have taken the Nic at Wye River..!!

You left off a 4th list in effect.  The company accepted Nicolau award.  The only list covering all LCC pilots.

Oh, and the West was not a party to the Protocol agreement.  Had we been, the Nic would have been the only starter for the LCC pilots.
