Ah the voice of espousing the Tyrany of the Majority.  All you have to do is find a lawyer to promise you the moon (again) and take your money (again).
 
Tell me Monsignor, were you planning on reordering the Empire pilots on AAA seniority list so as to reflect the "gold standard" of Date of Hire?  How about raising donations from the rest of your body and cutting the Empire guys a check for their losses over the years?

No fence swinging needed.  We have sucessfully beat little Stevie & his Van-down-by-the-river DOH gang.  USAPA delivered NONE of its promises.  It dellivered NO CONTRACT, years of delay, loss of wage, loss of time off, loss of benefits, a PILE of unresolved grievances (that APA now has to deal with), and it scooped up MILLIONS of dollars and delivered it squarely into the coffers of US Airways.  This while being the highest dues charging airline pilot "union".  USAPA is the poster child of epic union failure.
 
The VDBTR-DOH gang are now arguing a whole new seniority plan where USAPA/East Pilot Seniority Committee is trying to be "the new Nicolau".  We have a sound argument.  We have a stellar legal team, exhibits, and witnesses.  No matter what, the BOA is ultimately in control of this path.
 
Don't worry Freighterguy.  The arbitrators get it.  They will deliver (another) final & binding list next Spring.

And have "successfully" managed to lock ourselves in a tiny fishbowl and giving up so much financially along with so much growth............the bright side, maybe you'll be released in a few more years, remember FOS is having a lot of issues.

You voted for a legally binding new contract that included the enforceable/binding nullification of all previous agreements (completely reasonable demand of the company)... but you intended to immediately beg the courts to reinsert one of the former agreements you nullified by your own ratification, a former agreement that all parties agreed was nullified, and no party agreed to allow it to persist...  NO ONE.  You guys voted 98% and whine about "majority".  How ironic.  How unrighteous...
 
The courts did not fall for your whining.  The courts did no alter a single word of any contract.  
 
Where does that leave you?  All that money and time, and you still have the contract you/we ratified.  
 
Hint:  We all have exactly what we voted for... a fair and equitable process.

Marty has never argued the Nicolau list is "fair and equitable".  Never.  He always argued that the Nicolau is "final and binding" (making any question regarding "fair and equitable" moot).   To his chagrin, the courts have consistently, repeatedly, and conclusively rejected west unicorn visions of "final and binding".
 
Now Freund is before the arbitration panel and is stuck with a conundrum created by the silence of the Marty/Vasin amateur team.   Marty never once argued about "fair and equitable" so Freund is reduced to referring to the last person to argue the Nicolau list was "fair and equitable".. and that would be George Nicolau himself...
 
Freund said, "I will rely on what George said."
 
Maybe George was more prescient than any ever imagined him to be.  Maybe not.  
 
Boy, boys...take it easy. It's gonna JUST FINE. You wait & see. The BOA gets it, and will deliver a fair, final & binding list (again). You've got nothing to worry about.
