Now Kero wants to cloud the issue by playing up the number of West pilots senior to some arbitrary east pilot as if it blocks the rest of the east F/O's from ever upgrading, which of course it doesn't. He never comes out and gives an apples to apples comparison of Nic vs DOH, because it's too embarassing.

So what happens when the east majority retires and the west decides to re-order the seniority list back to the NIC without any no-bump provisions? I'm sure some LUP could be ginned up if necessary.

Just trying to point out that the west side does not get its retirements going real strong for another 8 years or so. What you want to do is capture the earlier east attrition and give it to the west guys then make the east guys wait for the younger west guys to retire before they get to move up.

But I doubt its going to be an issue. Currently both sides are enjoying their attrition that they brought to the merger. You are secure in the fact that not a single east guy will benefit from a west guys retirement in the next 2 years at least probably more like 5 so you are good........oh wait.....thats not what you are looking for is it?

Bad faith is but one of three DFR triggers. You forgot arbitrary or discriminatory. Do you think a fake union formed AFTER THE ARBITRATION to....get this....Arbitrarily reorder the seniority list to the sole benefit to the East and the sole DISCRIMINATORY harm to the West can be viewed an " arbitrary or discriminatory" act?

What did a Jury say about that? How long did it take them to get to that conclusion? How do you think DFR 2.0 will go?
