There is more language. A union is not laible for DFR unless it act in bad faith or is capricious or arbitrary. Is DOH one of these.
Don't think you will find a single case so stating.

DOH, in itself, is not capricious or arbitrary. Insisting on it after you didn't get it in negotiations and binding arbitration and totally disregarding said arbitration is downright malicious.

"DOH, in itself, is not capricious or arbitrary. " Indeed, it is not. The rest...you'll just have to try selling to people at some far, future point, should circumstances provide you an opportunity to do so.
 
The way out of any suit is the 3 way that will happen when LCC or AA pulls the trigger. There will be no harm to West as they never had a contract with the East going in.There will be no harm there as there is no history of a joint AWA AAA contract and that is the requirement to trigger the harm possibility. That is the easiest way out for all parties, although the West will not be happy about it. It clears the AA pilots and surviving company(AA) because AA has no history of anything related to Nicolau. That is one reason why they want the East pilots to give up change of control to clear the decks for AA to be the survivor.Not only is it logical for AA to be the survivor, it clears the West issue up completely. It is a very convenient out. I would imagine the AA guys want the youngest group of pilots the farthest down the list as possible, and a DOH for them is the best option to capture the East attrition and place the West where they want them. The East will be fenced off as long as possible to blunt the DOH issue, and make it a non issue. DOH with big fences works well for AA pilots.

Who, pray tell, will represent the west in a 3 way. USAPPU?
 
There will most likely be a merger. There will never be a joint East/West contract before that. Therefore, a 3 way list deal. Completely end runs the Nic issue, not that it is any issue any more. You will never see the trigger for your "harm" to even begin to spin up.

"End run the Nic." That is the goal of your fake "union" and the blatant evidence of DFR violation. Thanks for stating it for all to see.

Quite the contrary.....

Being on the West means making more money than our east counterparts, working under better conditions with better work rules, flying with co-workers who are much more talented and pleasant than our east counterparts (less violations, incidents/accidents to worry about).

West has a favorable ruling from the courts, an impending merger with AMR, local corporate headquarters, and extremely pleasant weather this time of year.

Oh...and we just wait for implementation of the Nic, and kick the scabs out of our jobs they stole.

The "three-way" referred to by Doug Parker in several crewroom sessions was specifically in response to the pilot SLI issue. The three DOH seniority lists that are currently in use, speak for themselves. How they would be ultimately combined will be the subject of ensuing negotiations between USAirways, APA and USAPA , a possible MB arbitration and rank and file ratification.

If the AMR deal goes down...that far future point will be about 8 months with a SLI using the NIc and rendering usapa moot.

Failing a merger, that far future point will be in about 2 months when the NMB leaves uscaba parked.

so it is your opinion that usapa could go to the table with two separate list for the pilots they represent and try to promote one at the expense of the other without any representation for the membership on one of those lists?

And...there are not 3 DOH lists.

You have the east list...not DOH. The APA list...definitely not DOH...and the West list...the only DOH of the 3.


You are probably mistaken. What will happen will be the combining of the AMR list with the NIc, with three or more "interested parties" contributing testimony to a McCaskill/Bond arbitration board.

Told you before Skippy the NIC does not effect me, just standing up for the rest of the gang, you furloughed boys should start looking for work else where.

Then I suggest you enjoy it because because that's all your have. PS I'm fine on LOA93 (speaking for myself only) Sorry about the NIC, try to get a grip on reality son.
