Maybe, maybe not. But at the time of our merger that is all that matters. Remember the usapa C&BL talks about un-merged expectations. Not post merger expectations or what happened un merged 3 years later.

If usapa is going to follow their C&BL they better be honest with themselves about what un merged career expectations were.

Tough defense in court when the union wants to put 85% of the west below furloughed east pilots when the east expectations were liquidation.

Read the merger policy. PID at the time of the merger that is all that matters. A/M merger policy at the time of the merger not 5 years ago or 5 years in the future.

A merger with APA with be about a point in time. The happen to be in BK. That is going to be a factor. No one got it wrong you just don't like the situation or the outcome.

TODAY, POST merger is a lot different than UNMERGED expectations 7 years ago.

LIQUIDATION!!!

US Airways would have been gone, buried and rotted away before the west found trouble in 2008. Maybe some of you would have even found flying jobs at other airlines. Maybe.

That is the C&R that usapa has to create if they want to use anything other than the Nicolau. so if you fools want to compromise or negotiate something staple the east is where we start.
 
Just in case any East pilots haven't read, specifically, exactly what the West AOL supporters demands are, they are posted below. Interesting reading! Anybody who thinks these guys are going to be willing to "modify" the NIC to reach an East-West majority consensus, to go in to an AMR merger with, are engaging in "wishful thinking". They have way too much time, effort, money and "ego" invested in playing this out to the end; As does the East. By the way, I could be wrong, but wasn't the original "Army of Leonidas" wiped out to the man?

We, the former pilots of America West Airlines, hereby declare the following:

1. We fully demand all of our legal rights, in their entirety, within the new US Airways, or any successor airline.
2. We require full, good faith compliance with our existing contract, the Transition Agreement and ALPA merger policy from all parties.
3. We will not allow our rights to be trod upon by USAPA, the East MEC, ALPA National, or the Company.
4. We will aggressively seek any and all available legal remedies against any party which might seek to dilute our rights.
5. We will not tolerate discrimination against the pilots of America West in any form, including the dilution of the Nicolau Award by any means, contractual or otherwise.
6. We will not engage in fruitless debates over matters already settled.
7. We will remain perpetually poised to aggressively defend our rights until such time when we are no longer threatened.
