Sorry Bub, but the Nicolau seniority list IS the compromise, the middle ground, and the ONLY legitimate & legal seniority list. It remains the ONLY seniority solution.

USAPA constitution & bylaws say it's DOH. Better HURRY and get that DOH list out now, so we can finish this NOW.

Well then, again for the reading impaired, tell the USAPA leadership to support a seniority decision in the courts first, not last. If is is the Nicolau, so be it. All contract negotiations should stop until the courts take a side.

Tell USAPA that the courts have to come out with a clear ruling that supports your position.

Age Discrimination & Harassment

It is unlawful to harass a person because of his or her age.
Harassment can include, for example, offensive remarks about a person's age. The harasser can be the victim's supervisor, a supervisor in another area, a co-worker, or someone who is not an employee of the employer, such as a client or customer.

Do you think we can sue ICAO and the FAA for age 60 discrimination and harassment with respect to the international cockpit crews? Seriously, has anyone considered this? I know suing the FAA requires an act of Congress to give permission, but how about ICAO?

merger situation,” see ALPA Merger Policy at Part 1.G.5 (emphasis added), and construct a “fair
and equitable” seniority integration that will:
a. Preserve jobs.
b. Avoid windfalls to either group at the expense of the other.
c. Maintain or improve pre-merger pay and standard of living.
d. Maintain or improve pre-merger pilot status.
e. Minimize detrimental changes to career expectations.
From the cactuspilot.org The Nicolau did not follow any of these for the East pilots. This award did not follow ALPA merger policy. B and E especially. ALPA was removed for failing to follow fair and equitable merger policy.
 
Sure. Anyone in Colello's position is a winner when you DO NOT keep your word, cheat, lie and steal from the smaller group.

He is a winner because of his years of service. NIC could not have been more wrong in his forecasts. It's plain that without the NIC to prop up the West, they stagnate just like everyone else. It would have been a very simple thing for NIC to give some sort of credit for LOS. Instead, he chose to discount every indication that all we needed was time.

One look at the operation, East and West today, is proof positive that NIC screwed up. That is why words are thrown about like "binding" and "agreements" ...because that is all they have to rest on. The East screwed up in it's demands for straight DOH, but that doesn't change the fact that there was a reasonable expectation that the arbitrator would be fair in any case. He was not and every day bares that out.

You pursued an award that was out of bounds with respect to ALPA merger policy. A WINDFALL. You should have done the right thing. You didn't. Your group caused the entire mess we have today. Someone with INTEGRITY would never have allowed it. It is not David vs Goliath. It is a group that will not stand for a windfall.

The other solution that could work also is to sell the west off, now wouldn't that be special..
Well it would end useless litigation against the CORP, allow synergies with a single contract! Just saying as well as prevent the continued operation of an obvious money losing hub!

Who is going to defend the "NIC" AOL? Not their award, ALPA said they won't in the NAUGHLER, USAPA sure won't, Dual ratification, and BTW no "ALPA" merger policy in place to cover it! SILVER and the 9th got it correct, "A BARGAINING PROPOSAL" and a windfall for a particular group, I believe a LUP is a contract with decent gains benefitting "ALL" parties!

Here is what you should have gotten: You and your previous reps were repeatedly lectured, warned, cajoled at WYE RIVER that you were going to get served if you pushed your WINDFALL. Johnny Mac was too stupid to listen. Guess what? It isn't INTEGRITY, it isn't DAVID AND GOLIATH. It is a bunch of morons who were repeatedly warned not to go forward with their windfall or they would realize ALL THE RISK LIES WITH THE WEST. Guess what? It came true! And everyone in the industry is going to watch what happens when you do. You get everything you deserve coming to you. All of you. And you are a PHX rep?
