I think it ironic how we both read the same thing and come to polar opposite conclusions.

I have not seen anything from Wake that would make him appear to be "talking out of both sides of his mouth." However, the circular logic employed by Seeham and usapa, now that is talking out of your mouth and your rectum all at the same time!!!


What do you think the odds are that Wake has a clue how the 9th is going to rule? I would say that it is very unlikely that he is in the dark, after all it has been postulated by some west pilots that Wake and the 9th judges are tight.

So, if Wake likely has a heads up on the outcome in the 9th what would provoke him to consider a stay on the remaining Addington issues?

You do realize that Nobody spends nearly as much time thinking about this particular case than the pilots right? Wake and the 9th are very VERY busy people. I don't think Wake thinks one iota about what the ninth is going to do. He's probably thankful that he doesn't have to be bothered with it right now. Also, how in the hell would anybody have any credible evidence that Wake and "the 9th" are "tight"? That's an absurd notion.

What would provoke him to consider a stay you ask? How about the fact that there was a scheduled hearing on the matter? That was one of the points of the meeting the other day. I know you guys are used to grasping at straws but this one is truly ridiculous. He's going to rule this week. He said so. I'm expecting him to issue a stay until the 9th rules. I'd actually be happy with that. Why risk wasting money, (both sides) until you know exactly how to proceed. The only concern is timing. The Court may be booked until next year and if addington can't get the damages trial started now perhaps there will be a year long wait....justice delayed is justice denied. So if Wake doesn't issue a stay, I would imagine his reasoning would have more to do with scheduling than anything else.

Something is going on.....a paragraph of USAPA's legal update below.

The judge indicated his interest in staying all proceedings in order to give the Ninth Circuit more time to issue its ruling, noting that if the Ninth Circuit Court of Appeals decides that the case was not ripe, then the pending district court proceedings are moot. For this very reason, USAPA’s attorneys agreed that a stay of this nature was warranted. Plaintiffs opposed any further stay and requested that argument and disposition on the pending motions proceed immediately.

Hate- the Baptiste and Wilder RLA blog cuts through the desert sand haze. Wake was in this way over his head. Proof? he absolutely was SALIVATING at the prospect of imposing NIC at the same time. Someone with some common sense brought him back to his senses. He took all the ground he possibly could for the West. The 9th is going to be like a company of MARINES landing on the beaches. Get ready for Wake to be sent back into the BUSHes...........

So I guess we will wait for a while longer as no one really knows. The only thing I know for sure is it's snowing like hell here in the east and the west folks are enjoying some rather nice weather.
