It's all about shining the light on absolute absurdity. What you said is no different than saying that it's illegal to enforce contracts or it's illegal to collect a debt. Are you kidding me? The Nicolau is a binding arbitration. What planet are you on?

And stuff like this, in a labor context makes him an easy target......He says misleading things like this, when the 9th Court of Appeals, says otherwise. Who do you think carries more weight, a court that already ruled, or a pilot/lawyer poster some years later???? Do you think labor law might be different than civil? Between the Desert Judge and Leonidas, those 9th Harvard clerks opened a major can of whoop a$$!
Let's hear the 2million argument on damage again. The one where Leonidas and Jacobs went before the judge and argued damage, before it happened, maybe it NEVER would happen! The judge, looking puzzled, asked the pertinent question to Jacobs: "Mr. Jacobs, how can you sue for damages in a car accident, before the accident happened, and what if it never happened?"Jacobs, "well your honor, we saw that car being driven in an unsafe manner, and one obviously could conclude the accident was going to happen in the future, so we sued before the accident actually happened! ...." That kind of end run keeps usloppy out of DFR how now?? They have a duty to fairly represent all not just the east and a move like that could be seen as unfair from the very onset. I say go for it though because the money on that move would come from LCC.

Big difference between a real war where peoples lives were actually at stake, and a seniority disagreement. I think the judge will be more real than a bunch of pilots, and tell them to talk, not shoot.

I say we're better off seperate ops, than we are even with the NIC. I'm not saying that becasue I want the east remaining underpaid under LOA93. I'm saying that because once we're one, PHX will shrink and I don't want to live out east. To add to that the NAC is negotiating a contract that is worse than our current west contract. Where is our incentive? I'm sorry I just don't see one. Best of luck to all.

I have a west captain friend that says exactly the same thing. He sees no benefit to a joint contract as he can not see enough from the company to offset the downside. He is very happy with separate ops, Nic or not.

Imagine the western scurrying around. The Lenidas group must be in a tizzy now. Spoke with Move2Clt since the get together and he is majorly concerned. The Lenidas and the rest are splitting in two as we speak. The junior western and their Nic ideas are not well received going forward. The senior western are willing to negotiate.
