It's all about shining the light on absolute absurdity. What you said is no different than saying that it's illegal to enforce contracts or it's illegal to collect a debt. Are you kidding me? The Nicolau is a binding arbitration. What planet are you on?
And stuff like this, in a labor context makes him an easy target......He says misleading things like this, when the 9th Court of Appeals, says otherwise. Who do you think carries more weight, a court that already ruled, or a pilot/lawyer poster some years later???? Do you think labor law might be different than civil? Between the Desert Judge and Leonidas, those 9th Harvard clerks opened a major can of whoop a$$!
Let's hear the 2million argument on damage again. The one where Leonidas and Jacobs went before the judge and argued damage, before it happened, maybe it NEVER would happen! The judge, looking puzzled, asked the pertinent question to Jacobs: "Mr. Jacobs, how can you sue for damages in a car accident, before the accident happened, and what if it never happened?"Jacobs, "well your honor, we saw that car being driven in an unsafe manner, and one obviously could conclude the accident was going to happen in the future, so we sued before the accident actually happened! ...." Judge "but what if that accident NEVER happened?" Dr. Jacobs, Dr. Jacobs..... Leonidas, Leonidas, Leonidas?????????? And that, was what they spent 2 million dollars on! Aqua, aren't you a lawyer, didn't you see how obvious this was???
[8] Plaintiffs seek to escape this conclusion by framing
their harm as the lost opportunity to have a CBA implementing
the Nicolau Award put to a ratification vote. Because
merely putting a CBA effectuating the Nicolau Award to a
ratification vote will not itself alleviate the West Pilots furloughs,
Plaintiffs have not identified a sufficiently concrete
injury.2 Additionally, USAPA’s final proposal may yet be one
that does not work the disadvantages Plaintiffs fear, even if
that proposal is not the Nicolau Award.3
