Recognizing USAPA’s Broken Campaign Promises
Who USAPA BPR and Officers.
What Failed or Broken Promises made to the pilots during the NMB
Representation Election.

Why USAPA officials misrepresented their intentions so as to hijack our
union.
During the Addington trial USAPA Communications Committee
Chairman Scott Theuer discussed USAPA’s pre-election FAQ’s indicating
the new union would be more democratic. Theuer stated USAPA would
have a direct election of Officers, there would be more control over
financial matters than the incumbent union, and there would be pilot
ratification of all contracts, side letters, and important union business.
He further indicated there would be more thorough and timely
communications, a Constitution with a Bill of Rights that mandates
professional negotiators along with better, more efficient services
provided, and a merger policy that preserves each pilot's unmerged career
expectations.
Also, Theuer indicated USAPA would have no more gravy train for
Officers. Reps. and Committee members, union officials would be paid no
more than what their seniority can hold, the Union would use the same
hotel as crews, there would be no more limos and resort hotels, meetings
would held at bases in the terminal so it's easy for pilots to attend, and as
soon as possible BPR meetings would use webcams.
Promise #1 The new Union would be more democratic.
Fact During last spring’s presidential election the Ballot Certification
Committee excluded a pilot in good standing from running for office after
the pilot indicated he did not agree with the Constitution and Bylaws. The
pilot filed an appeal, and after legal review, USAPA was obligated to rerun
the previous illegal election.
Promise #2 There would be more control over financial matters than the incumbent
union
Fact USAPA has not published a budget on how they spend YOUR money.
There is no union transparency nor any way for members to verify how
union monies are spent.
Promise #3 There would be pilot ratification of all contracts, side letters, and
important union business.
Fact Without the members having any pre-meeting notice of their intentions,
the BPR voted a stipend pay raise for the Officers, NAC, Grievance,
Merger and Communications Committee Chairman. They also created
language to grant this stipend to any other pilot they choose.
Promise #4 USAPA would have a Constitution with a Bill of Rights that mandates
professional negotiators along with better, more efficient, services
provided.
Fact USAPA NAC Professional Negotiator Scott Peterson is an attorney from
Seham, Seham, Meltz, and Peterson Law Firm, the firm fired by the
American Airlines Pilots Union (APA). The NAC has never told the
membership how they use Peterson in negotiations, nor has Peterson (our
negotiator) provided any information to the pilots.
Promise #5 USAPA would have a merger policy that preserves each pilot's unmerged
career expectations.
Fact USAPA created a DOH merger policy. This policy was created for the
sole purpose of violating the final and binding Nicolau Award. For this,
USAPA was found guilty of breach of DFR. The USAPA merger
policy/DFR verdict has now given way to USAPA having the Nicholau
Award imposed on the pilots, unmodified, via the judge’s injunction, as
well as USAPA standing before the court as the Defendant in a damages
lawsuit.
Promise #6 USAPA would have no more gravy train for Officers, Reps. and
Committee members.
Fact 12 USAPA officials receive between $1,000 to $1,500 per month bonus
pay.
Promise #7 Union officials would be paid no more than what their seniority can hold.
Fact Most USAPA officials who receive Flight Pay Loss (12 of them) – receive
85 Hours on any equipment they can conceivably hold – however, most
can only hold reserve on the better paying equipment. With the new union
official pay plan these pilots receive 85 hours pay per month plus the
stipend. This policy enriches the USAPA elite far beyond what their
seniority would otherwise allow them to earn.
Promise #8 There would be no more limos and resort hotels.
Fact Some of USAPA’s meetings are at the Sterling Hotel in CLT, but many
are at the Hyatt Place. Following the election, USAPA authorized its
officials to receive more per diem than line pilots by changing the bylaws.
Promise #9 BPR meetings to use webcams for videoconferencing.
Fact There has not been one BPR meeting webcast. USAPA doesn’t even
publish timely and detailed meeting minutes.
Conclusion USAPA’s Broken Promises:
ALPA did not provide 12 union officials stipends of $12,000 to 18,000 per
year but USAPA did without membership input.
The USAPA Constitution and By-laws states in C&BL 5(e) - For
expenses related to negotiating a new Collective Bargaining Agreement,
the BPR is authorized to increase dues by ½% of qualifying income and
for C&BL 5(f) - For expenses related to a proposed merger or acquisition,
the BPR is authorized to increase dues by ½% of qualifying income.
Prior to the NMB Representation Election USAPA indicated member dues
would be 1.5%. But, according to Secretary/Treasurer Rob Streble said,
“Members shall pay dues based on qualifying income at the rate
established by the Board of Pilot Representatives (which are currently
1.95% for members and were originally established for Nonmembers at
1.65%).” However, USAPA recently raised the Non-member dues to
1.833%.”
