The only logical methodology for the APA is to not use the Nic. To use the Nic would be to put the far junior western div pilots ahead of the already retiring eastern div pilots. That does not make any sense at all to the APA. The APA pilots are well aware of this, and are already planning to use it to their advantage.
LOL, man this one is good. Those seats are vacated and positions open, the west pilot age has no effect on movement for the amr pilots, because we are slotted. BTW the beauty is the west Pilot's get to claim the east attrition, lol. But just for fun, tell me which list will be used, show your work claxsucker.

The reality of what may befall your western working brothers and sisters is rather alarming. The APA is well aware of the best system for them, and they will most assuredly use it. I merely made you aware of what you already are slow to realize.

I do believe that, as many of your east brethren have posted, the APA is going with relative seniority.

Oh, BTW, that no furlough clause extends to ALL workgroups on BOTH sides.

Not my work to claim. Merely advising you of what the APA is aware of in the potential merging of lists. Past practice indicates they are not the most charitable fellows when it comes to seniority, and the fact of your Nic scheme and its' needing to be in a ratified CBA to be legal has certainly not escaped their most observant and trained eyes.

"After Dave left it was back to Q&A with Rusty and Russ and I asked Rusty about the seniority merge and the Nicolau award. Dave had basically said it was not a factor but Rusty wasn’t sure said the lawyers had differing opinions on it but said it should come out to where if you are at the 50 percentile point on your fleet your combined seniority number would put you at that place. Said that this along with seat pay protection might solve the Supp CC problem but if not then it would be decided by another 3 person panel."
 
The Nic will not be referenced by the APA in any legal document because it was not memorialized by a CBA. It is merely a dusty relic sitting on Parkers' shelf, waiting to be shredded when the AA deal moves on without it.

That is quite an impressive document, that little discussion by someone named Dave and Rusty. The part where "Dave had basically said..." is especially important and legally binding. 😱 Let's not forget the "IT SHOULD come out to where...." This must be the kind of thing that makes your employed brothers and sisters begin throwing coinage at shady lawyers.

Until Silver rules and memorializes it.

A vote is not required or allowed on a seniority list.
 
If it makes you sleep a bit easier, our lawyers have already been in contact with both the APA and the company.

That is a most assuring statement. Makes everyone feel better because that is the exact pathway to understanding the TWA pilots took with the APA, and as you are aware, they received a most charitable reception as well as outcome.
