As you all are well aware LEE MOAK was elected the NEW ALPA president following JOHN PRATER, MOAK the new PRES has had some interesting well not to be shy some interesting statements about USAIR and it's PILOTS , and were not just talking about today , we go WAY BACK, now what is CURIOUS he mentions USAIRWAYS in his recent speeches, WHERE ARE THE AIRTRAN PILOTS? Wow guess they fell under the radar! I know he is still reading the " ART OF WAR" doctrine book and all !(PLANEBUSSINES BANTER MAR 8, 2010 VOL 14 ISS 9 a must read) But hey how bout the PENSION INVESTIGATION at USAIRWAYS, and the ALPA connection you bet he wants in! The quote book is alive and well, We luv some LM! MM!

Funny. I seem to remember a Conviction and subsequent Injunction attached to your fake Union in Arizona. It'll happen again. Won't even break a sweat. :lol:
You may want to rethink ""won't even break a sweat"... clean slate and all... with the 9th's ruling... any judge should tread lightly and follow the rule of law! Sadly... Judge Wake couldn't see the case wasn't ripe... and when ripe... not necessarily as you think it will play out!

And who exactly are you talking to? The west can neither accept nor reject DOH to get the process moving; that issue is entirely between USAPA and Management. In the latter case, Management has filed a DJ to have the court issue a declaration regarding the Company's acceptance of the NIC and USAPA's proposed DOH list. Nothing will happen until that process is complete unless USAPA informs Management that that the NIC is the list and that they consider section 22 to be closed.

The bottom line is that if you want to process to accelerate, USAPA must accept the NIC and move on. Otherwise all of the legal processes will have to be pursued at the pace of the courts. At any rate, I think it should be abundantly clear that USAPA has zero interest in attaining a JCBA as they know what the seniority system will be once that happens - the unmodified NIC.

Let’s see what has USAPA done thus far?
Leading up to DRF I – USAPA proposed pay rates so unrealistically high that they effectively halted negotiations. No reasonable counter-offer to the Kirby has been presented by USAPA which means USAPA, rather than Management, has put negotiations on ice.

Upon receiving a guilty verdict in DFR I, USAPA appealed rather than accepting the court’s decision creating more delays in the JCBA process.

Rather than asking the 9th to rule on the merits of the DFR, USAPA/$eham expended most of their efforts towards the ripeness issue which ensured even more delays rather than actually seeking a definitive resolution to the seniority issue.

When Management filed for the DJ to bring a final resolution to the seniority issue, USAPA/$eham opposed the motion showing that they prefer a stalemate rather than a resolution and a JCBA.

So what actions has USAPA actually taken to negotiate a realistic JCBA with Management and to remove all legal doubts about the seniority list that must be used? Oh wait, they did ask for NMB mediation assistance – a process that is guaranteed to slow the process down to a crawl at best.

USAPA owns every bit of the delayed contract and it seems every east poster on this board agrees that if the LOA93 goes for USAPA that there will never be a JCBA. Doesn’t that belie the claim that USAPA and the east actually interested in a JCBA? Which is it – does the east want an JCBA or do they want separate ops with LOA84 until retirement should the rabbit get pulled out of the hat on the grievance? The answer reveals the true confiidence the east has in getting their precious DOH.

Well, so what is not "unrealistically high"?.....................

I don't agree "that there will never be a JCBA" with a USAPA LOA 93 win. There may never be a JCBA here anyway, but not because of LOA 93. But then again, maybe the West Pilots should go to Parker and offer to sign a five year LOA 93 contract going forward with NIC as section 22, he may bite at that one.

If Parker wants to part this place out, it will be much easier to do it with a West and an East Division. That may very well happen, so don't be so quick to blame it all on USAPA, I'd be real concerned if the only way you make money is by charging for checked bags........and that is where we are at right now..........
