So why doesn't USAPA fulfill it's responsibility to the west pilots and open Section 6 negotiations on the west contract and set aside negotiations on a joint contract? Negotiations should be handled exclusively by a subcommittee of the NAC and staffed exclusively by west pilots. A similar east subcommittee could be created for negotiating a new east contract.

Just because the company said they weren't willing to negotiate separate contracts doesn't mean they couldn't be compelled to if USAPA petitioned the NMB citing the court delays. West pilots could have the improvements they deserve and the integration is shelved.

What is USAPA's motivation for peeing in the punchbowl instead of making lemonade out of lemons?
 
Obviously, Bob supports his fellow pilot, which is saying a lot, considering that with his seniority and upcoming retirement support the fact that he is standing up for what is right in all this BS, while he could just turn his back and leave.

And his massive frustration. These guys have been saying for years that any day now the senior east guys will tire of LOA 93 and throw the junior guys under the bus. When Bob and nycbusdriver, who are both very senior, prove them wrong, it infuriates them. They can't understand why they aren't like Jim, while we know why. Bob is a class act.

Name calling is all fodase has. Old fodase doesn't really bother me and I think he may be the smartest of the bunch of westie rowdies. He at least knows that's all he has! :lol:
 
You just identified why you are going to lose this grievance. This is a yes or no question. Does LOA 93 contain pay restoration?

If yes point to the language in LOA 93 that tells the arbitrator what rate it goes back to. The arbitrator does not have the latitude to make up a rate. So if he has a choice between 18% plus 3% OR full restoration. His answer is going to be NO!

Arbitrators read language and tell both parties what it says. If he can not take a highlighter and say this is the rate. You are not getting it.

There are no pay rates in LOA 93 only pay rate modifiers. All East pay rates (except the E190) are calculated rates based on the 1998 contract Captain rates adjusted for a series of subsequent modifiers. The A320 Captain rate peaked at around $225 an hour 10 years ago and then has had a long series of rate modifiers applied to get effective rates until 1/1/2010.

The rates can't be made up as you state they have to be mathematically calculated. The company is trying to dispute the meaning of the language of the LOA 93 pay modifiers specifically the meaning of the words "freeze" and "through 12/31/2009" even though these are very common contract terms and have long established legal definitions. The Arbitrator can't change the contract so he will only decide exactly what the existing language means....the math is then easily done to arrive at the current rates.

I have asked this before and got one answer that I believe to be incorrect.

If it is easy do the math. What do you think the rates goes back to? If LOA 93 modified a rate. Give me the hourly rate that the arbitrator can logically follow with the language in the contract.

Do you think the arbitrator is going to go back to $225 an hour? Do you think it is something less than that? An 18% cut of $225 does not yield $125. So take a highlighter and highlight the language that will tell everyone what the hourly rate will be. You said it was easy.
