Clear,You just identified why you are going to lose this grievance. This is a yes or no question. Does LOA 93 contain pay restoration?
If yes point to the language in LOA 93 that tells the arbitrator what rate it goes back to. The arbitrator does not have the latitude to make up a rate. So if he has a choice between 18% plus 3% OR full restoration. His answer is going to be NO!
Arbitrators read language and tell both parties what it says. If he can not take a highlighter and say this is the rate. You are not getting it.

There are no pay rates in LOA 93 only pay rate modifiers. All East pay rates (except the E190) are calculated rates based on the 1998 contract Captain rates adjusted for a series of subsequent modifiers. The A320 Captain rate peaked at around $225 an hour 10 years ago and then has had a long series of rate modifiers applied to get effective rates until 1/1/2010.
The rates can't be made up as you state they have to be mathematically calculated. The company is trying to dispute the meaning of the language of the LOA 93 pay modifiers specifically the meaning of the words "freeze" and "through 12/31/2009" even though these are very common contract terms and have long established legal definitions. The Arbitrator can't change the contract so he will only decide exactly what the existing language means....the math is then easily done to arrive at the current rates.
