They represent me, but they don't VOTE for me! They form commitees, but they don't bind me under the major agreements we have control over NOW unless and until we have a vote. ALPA allowed the MECs to negotiate side letters that bound the rank and file in the past but we changed that and oh, side letters can ALWAYS be amended INCLUDING SENIORITY!
ALPA, USAPA, Teamsters, etc. NEGOTIATE for a CBA on all of our behalf. They CANNOT bind you. THAT IS THE WAY THIS WORKS as the Ninth Circuit says:
"Although absence of a CBA might be evidence of a DFR violation, if the violation were based on deliberate delay by the union, it is not evidence of a union’s improper preference of one seniority system over another. As demonstrated by ALPA’s similar difficulties in reaching a CBA, the pilot groups, and individual pilots with their ratification/nonratification powers, are the major contributors to the absence of a CBA in these circumstances.
I am claiming here that IF & WHEN a CBA becomes availible for you & I and every other pilot on the premises WHO ARE MIGS get to vote to ratify or not ratify the CBA they negotiated. Every pilot on this property, save YOU understand that.

What if they file bankruptcy?That is an easy question. That liability transfers to the teamsters. The new union takes any responsibilities and liabilities. Just like usapa an arbitrated decision does not just go away with the changing of a name. Damages does not just go away if you change bargaining agents.
So if anyone thinks that the teamsters are going to jump at the chance to represent US Air pilots without some serious thought they better think again. This usapa experiment is not going to get to do 3-4-5 years of damage and walk away. Some one is going to be held responsible.

... Why is the date there? And even more importantly of why the dates are so important, ESPECIALLY the start date,(even more than the end date) clearly 5/01/04 is this: This is the START point. They could not reach earlier into the contract to achieve the lower pay rate. Did that FREEZE start any other date? NO. Why not? It had that date. An east pilot looked at his W-2 and saw the cut started on that date.
... as that is the date the cuts started, then how can they arbitrarily blow off the Dec 31 2009 as some date that means nothing? They can't! It has absolute meaning as does the first date, when something drastic started.Something drastic ended.
