APA cannot legally use the NIC if there is no contract prior to merging the 2(3) groups.
Why?

The Nicolau is the accepted seniority list by the company. The T/A says we have to use the Nicolau list. If there is a merger usapa is going to have to had over a single list not 2 lists. It may not be used for bidding purposes until we have a joint contract but Nicolau is the combined list.
 
And to add to that, it looks like the ruling on the Appeal Board elections isn't quite cut and dry.

This is what happens when you pay for legal counsel and then disregard their recommendations.

So Hummel went out and paid a personal visit to the law firm and was told some very disturbing stuff regarding the decision to overturn to election.

And now Jay Morgan of the Ballot Certificaiton Committee comes out with:

"An official announcement will come out from the Appeal Board when it is official. I am aware that a decision was 'sort of' released. There was a problem with it and it is not official."

I can't wait until Hummel takes over. The neck-deep crap he's stepping into is going to prove amusing as he tries to crawl out if it.

This Complaint is brought forth by a Plaintiff who is employed in Mecklenburg County
North Carolina against Defendants who conduct their business in Mecklenburg County, North Carolina.

The subject matter of counts and the venue are a matter for a Mecklenburg County Court.
The Defendants' through their authority violated their fiduciary duty by certifying to false statements. The Defendants' caused the Plaintiff to be fired. The Defendants' misdirected the union dues of the Plaintiff. The Defendants' sent out false statements with the intent to deceive.

No, they're just routes with higher yields that cover our higher crew costs.

Why? Do you think we don't get paid more than you do? I can show you our rates.

I'm curious as to where this 24% number came from. Can you post the source?

You seem so concerned about this 24%.

How about you give us some details.

Is it the west doing 24% of east flying or is it 24% of the west flying comes from the east?

You guys always leave out the part about the 4% that that the east is doing of west flying.

Tell us what is the net effect of this shift in flying? usapa lied to the court and said it would effect 330 pilots. Care to prove the case?

BTW who do you think has higher work rule costs? East or West? Listen to Parkers crew news he has said that the TOTAL cost for crews is about the same. So that means because you are at the bottom of the industry wages your rules must be more expensive. You think all that training you guys do is free?
