Lack of a ratified contract does not nullify arbitration. There is only one integrated list. That list is not a made up DOH list.
If there was an enforceable single list UHaul would live in CLT. There are presently two contractual seniority lists and no one is at liberty to state otherwise, at least not unless they wish to make Wake appear like a choir boy.
 
However, if the TA is never consumated, all bets are off....as if the merger never happened in the pilot's arena. The NIC nor the DOH lists were ever consumated, and the objection from our new union has never been addressed, legally. The AWA and USAir pilots were never merged, so now, unless Judge Silver makes a ruling before a merger, the attempt to merge the AWA pilots and the USAir pilots failed...as if it never happened.

Silver will, at the very least, warn Parker of the dire consequences of leaving the Nic. Parker won't budge off of it.

And in about a year, the wife and I will fly out to CLT and drive north to start looking around for a new place to live.

From another thread via APA reference: "Dave went on to talk about how badly the AW-LCC seniority merger was done and said that this will be the opportunity to fix this for once and for all. It will fall under McCaskill-Bond which means it will be a 3 member board that decides if we can’t negotiate a deal and it will stick." Who would the APA be negotiating with?

"I asked Rusty about the seniority merge and the Nicolau award. Dave had basically said it was not a factor but Rusty wasn’t sure said the lawyers had differing opinions on it"

I certainly don't pretend to know how all this will turn out. It does seem there's less "done deal" sentiment where the nic's concerned from the APA than many imagine....jus' sayin'

If Nic had gone with a DOH list, you'd be jumping up and down screaming that it had to be used even if it weren't "ratified".

The integrated list never had to be ratified - it was final and binding without anyone having a vote except Nic. Even USAPA's merger policy agrees with that. Per the TA, the Nic just couldn't be used till the single cert and contract were in place. The Nic is legal and binding. The only "legal" objections the east has is that they consider it unfair - too bad, so sad, that's life...

Why wait? It will just cost more next year. Mortgage rates are about as low as they can get. Just commute for a bit. One of the west posters said that this merger will be complete by the end of the year.

Date of Signing - $181.92
Year 2 - $187.38

Year 4 - $198.79
Year 5 - $204.75
Year 6 - $210.90


Might want top recheck your facts or where your getting them from. Term sheet I saw says the following:


The big question of course is, where anyone has seen that these pay rates will apply to all three pilot groups? Thought I saw it somewhere in one of the APA letters but can't find it again, so might have imagined it. Have a feeling this will be only for the AA side of that 7 yr fence.
Pay raises of approximately 5.5 percent on date-of-signing (subject to final agreement on valuations and other areas of the contract). Twelve-year captain rates of pay on date of signing would be:

Group I – $116.74
Group II – $172.44
Group III – $185.69
Group IV – $216.07
* The above pay rates will receive annual raises of three (3) percent for five years. The agreement also includes a provision at the amendable date to reset our compensation to the average of the total compensation of pilots at Delta and United airlines.

So on DOS the Airbus et al 12 yr capt rate would be 172.44. Not your estimated 181..92

So it should actually look like this here......simple reading and math.

DOS 172.44
+1 - 177.61
+2 - 182.94
+3 - 188.43
+4 - 194.08
+5 - 199.90

So as you can see, about a 10/hr difference then what you figured. Imagine that, USA320 not having exactly the most accurate facts...HAHAHA

Why wait? Mortgage rates are as low as they can get. It will be more expensive next year. One of the posters here mentioned that this merger will be complete by the end of this year. Just commute from CLT until you get your bid there. No sense in waiting if you are that sure.
 
What part of your not the majority anymore don't you understand?

You guys go ahead and vote all day everyday against a new contract with the Nicolau used in a new list. It will not matter. The 11000 other votes will.

Besides in the next integration the Nicolau will be diluted by the 9000 AA pilots. It will only hurt a little.

Not to rain on your parade, but this merger has a lot of hurdles to jump. So far it looks good but nobody else has had a chance to respond. I would not call it a done deal yet.
