You can stop begging the West to come off the NIC so you can get a pay raise, it ain't going to happen.

They will never get it. Sure has been fun watching them all gloat over their latest bid. The lack of intelligence and true lack of character is crystal clear.

No change Clax. Here are the words that are the most important in Judge Silver's order: "..US Airline Pilots Association’s seniority proposal does not breach its duty of fair representation provided it is supported by a legitimate union purpose (LUP)...."

Hurry up and get us a contract with DOH / DOH-lite. Get LCC to sign on the dotted line, and we will be "off to the races"!

Hey! Here's a great idea: Why don't you fill pages up here on how many upgrades you're going to get, and how you are instructing the new hires to keep the Westies fenced in PHX so that the new hires can be Captains in a few years?

SYIC-A

Cactusboy and Cleardirects' Last Stand. Their new buzzword- LEGITIMATE UNION PURPOSE. We went from Judge Wake, to Ripeness, to Unripeness to Leonidas to Judge Silver to DFR I, DFR II DFR III. Now it is LUP. What will it be next time you lose? Can you say PAINTED YOURSELF INTO A CORNER??? WYE RIVER is the best one.

"If you hope that her choice of words contradicted, rather than affirmed, the 9th and"..SCOTUS...That does indeed seem to be the most definitive delusion du jour...well...that and the assumption that "legitimate union purpose" wouldn't be judged based upon the highest court in the land's established standards for "reasonableness", but rather in their parochial, desert venues instead.

Methinks that astounding surfeit of "righteousness" impedes any actually rational thought out there in many cases.
Speaking of delusion, one has to laugh at the "AOL" ST. NIC wish list in the form of BPR resolutions forwarded by "MARTY'S ELVES" the PHX reps! Got a good," NO, NO, NO", ST. NIC , LMFAO!

At least Marty paid for his lunch.

Unlike Seham that walked out on his bill and left usapa to pick up the tab.

Better rethink that statement Cleardirect. You paid, in spades. That Unripe fruit served up was mighty expensive.

[2] No published case has expressly addressed when a
DFR claim based on a union’s negotiation of a CBA becomes
ripe. Thus, we apply the general principles underlying the
ripeness doctrine and take guidance from our decisions
regarding the related issue of when a DFR claim accrues for
statute of limitations purposes in the context of the administration
of a CBA. We conclude that Plaintiffs’ DFR claim is
not yet ripe.

They think the rejection of the motions will be irrefutable evidence of guilt. They forgot to add a motion to change the cb&l to use ALPA merger policy exclusively for SLI (not current ALPA merger policy but the old one).

I'm sure it's all billable hours for Marty's college fund, vacation fund, boat fund, etc.

Claxon: "Cactusboy and Cleardirects' Last Stand. Their new buzzword- LEGITIMATE UNION PURPOSE."

So it seems.

Does usapa have a LUP. That is what the company and usapa have to get by because that is her order.

IF we're allowed here to even briefly eschew the entirely faith-based notions you and yours have...well...I can easilly see several courses of action leading to an eventual contract that I'd think would reasonably constitute legitmate purpose here myself, none of which would suit current west fantasies.

In any case; do be so good as to explain to us all the established legal definition(s) of an "LUP"? After you're done feebly struggling with that; further explain the SCOTUS notions of "a wide range of reasonableness"....?

Not even close!

If you want a clue...go read the TA.

No problem...

Usapa or any union is free to negotiate within a wide range of reasonableness, provided it's method is neither arbitrary, discriminatory or in bad faith.

That is the entire definition....usapa fails the wide range of reasonableness test and has no LUP.

The lack of intelligence and true lack of character is crystal clear.

So Ames; How many more years worked/hours flown than yourself do the people that you would magically and instantly be made "senior" to via the nic have? Note that the nic would advance you through ZERO reasons of your personal merit, any semblance of superior achievement or even work performed on your part. Spare all sentient creatures your perverted little fantasies that you supposedly have any noteworthy (much less superior) "intelligence" or "character". Have fun commuting to PHX.

Yet, even after you "won" in the Ninth appeals court, you have done nothing.

Actually they have done a few things.

They held info picketing to be laughed at by the media.

They sued in the NYC court, to be laughed at by the federal court.

They started an illegal job action, and although the company was not laughing, the West most certainly was....

Now they plead to the NMB...it is like going to a comedy club...after you have laughed hard for a while...it gets old and your stomach starts to hurt.

Yes, yes, and the tribe's "Ghost Shirts"/Integrity Matters T's will keep you all safe from the cavalry's fire.

I'll leave any such issues of pure faith to be eventually determined by the court(s)...should such testing ever even happen.
