Judge Tosses Pilots Union RICO Suit Against Rival

Law360, New York (July 15, 2008, 12:00 AM ET) -- A federal judge has dismissed a suit filed by a union representing pilots at U.S. Airways Group Inc. against a rival pilots' group seeking damages for violations of federal and state racketeering laws in the wake of the 2005 merger of U.S. Airways and America West Airlines.
Judge Martin Reidinger of U.S. District Court for the Western District of North Carolina ruled on Friday that the U.S. Airline Pilots Association's case against AWAPPA LLC did not meet the standards of the federal Racketeer and Corrupt Organizations... It did not meet racketeering charges it did say you did tie up the safety hotline and send feces to USAPA !

Wow claiming victory , for you taking 17 years of advancement over the LAA pilots, you thinking that you bought USAIRWAYs, you thinking that a 2007 ALPA merger proposal never put in a contract, upheld in Breeger and the 9th justifies a2000 hire senior to a 87 hire , 3 arbs with a set of restrictions set forth in a protocol agreement , my only hope is the 27+ hires on your list that gave up over 170'000 like MCADAmS sue your ass!

Congress' McCaskill / Bond is the SAME footprint of the ALPA Merger policy. ALPA Merger policy calls for the SAME process. Once again, Grasshopper, you are blaming ALPA for something that they did not do. ALPA did not wrong you in this process:
1. Your party agreed to the process.
2. Your party chose Arbitrator Nicolau.
3. Your party argued for Date of Hire.
4. The Arbitrator AND the experienced Pilot Neutrals rendered the arbitrated list.
5. Your party pitched a fit and RAN away from the contract negotiation table.
6. Your party willfully created USAPA for the sole purpose of evading the Arbitrated Seniority List.
Not adult behavior by any means.
