THE COURT: The record will show the presence of the jury, counsel.  Will the foreperson please tell us whether the jury has unanimously reached a verdict.
JURY FOREPERSON: We have, Your Honor.
THE COURT: And will you please hand it to the clerk.  All right. And will the clerk please read and record the verdict?
THE COURTROOM DEPUTY: Omitting the caption, we the jury, duly empaneled and sworn in the above-entitled matter, find as follows: On the plaintiff class's claim for breach of duty of fair representation against defendant USAPA, in favor of plaintiffs.

Don Addington, et al.,Plaintiffs, vs. US Airline Pilots Association, et al., Defendants.
Jury Trial, Day 11 – VERDICT

(BTW it took less than 2 hours for a jury to determine that USAPA FAILED to represent the West pilots)

The National Mediation Board on the subject of contract continuity:

"When there is an agreement in effect between a carrier and its employees signed by one set of representatives and employees choose new representatives who are certified by the Board, the Board has taken the position that a change in representation does NOT ALTER OR CANCEL ANY EXISTING AGREEMENT made on behalf of the employees by the previous representatives.  The only effect of a certification by the Board is that the employees have chosen other agents to represent them in dealing with the management under the existing agreement”

In the matter of: Preliminary Arbitration Board APA/USAPA/AA (December 17, 2014)

ARBITRATOR JAVITS: All three lists. I guess the gravamen of the questions is are you then putting yourself in the place of Nicolau, are you the new Nicolau because you are proposing a list which may not reflect Nicolau's list? ….. And American pilots. And, therefore, you're making a proposal, which may be different than what Nicolau had in mind and issued back in '07.

MR. FREUND (in closing):As the Chairman put it so nicely in his questioning of Jess Pauley, what the US -- what the East Committee, the US Airways Committee, the USAPA Committee, call it what you want, what it wants to do is to put itself in the place of George Nicolau and redo what George did in 2007.

it's always refreshing to meet a "man" of such consistent "principles"....
You are fine example that bad parenting results in a lifetime of issues. Sorry pal, you can't cheat and attempt to intimidate others to get ahead with it catching up to you someday. I'm enjoying the smack-down you deserved, pyramid building sack of schit.

Looking forward to arbitration.

.....Scabs like you tried to bankrupt my co-workers with false RICO charges and falsely accuse others of ID theft. By attacking them, you attacked their families, scumbag.

I merely pointed out your obviously infantile and wholly nonsensical use of the term "terrorists", but must once then again ask of you just what the casualty count there was? How many beheaded or blown up?

And DO, pray tell us all just what "smack-down" that's been/is, or will ever be kid? "You'se' can't even find it within yourself to accept so much as a recreational flying wager, and per your "heroically" posted fantasies of seeing kids "beat up" at school boy bus stops?...Sorry, but I was years past that by the time you were even born.

Cactuspilot1: "you deserved... pyramid building sack of schit." "Looking forward to arbitration." That last's fully understandable, since sans some arbitrator; you clearly aren't anyone to be at all considered an issue personally...other than to just laugh. 😉

Of course you are, you have nothing else,

Don't forget to tell them all you bring to this merge and try to keep a straight face when you do.

You keep us laughing all day.

I attended the meetings when the fundraising got started to defend against lawsuits usually reserved for the likes of Al Capone. Your side was using financial terrorism against these people's families. That includes their wives and kids.

Terrorism comes in many forms. Usapa used those tactics.

Not to sell them short here...perhaps just a mighty cry of "This is Sparta!" will make all the difference? 😉

Wager? I'd have to talk to a scab about that and I don't talk to scabs.

Does it really kid?  I've been suffering under the clearly erroneous misconception that real life vs death, actual terror was necessary for the term "Terrorism"  to be at all true....but then; maybe I just didn't watch enough "Oprah"/"Dr. Phil"...?

Sigh!...And yet your above post stated your willingness to make an exception to that "policy", and here we are, several posts later, still "talking"...but apparently; only within boundaries that keep you feeling safe...and of course "tough"? Care to explain that kid? 😉

Well then, since you are supremely confident you have nothing to worry about. WYE then do you keep crowing that it's "over", and that you have won??
BTW, the NIC is not dead (as liar-Luvr claims). It's still on Mr. Parker's desk.
You must be referring to his desk in storage in Tempe. The janitors use that one for card games during breaks. They were wondering what that paper was that referred to some Greek dude.

November 11, 2008 (Q&A in Phoenix with Doug Parker)

Pilot: . . . . My question though is I was at the hearing for the furloughed guys and one of the possibilities they were discussing is moving 190s to the west and can’t do that. You know why.

Parker: Why

Pilot: Binding arbitration. So the company believes in binding arbitration. We have a binding arbitration for seniority. Does the company believe in binding arbitration or not?

Parker: The binding arbitration you’re talking about I think – I’m pretty sure what you are talking about – that was an ALPA process that resulted in binding arbitration. That wasn’t a company process. That’s ALPA to ALPA seniority integration that says if you can’t get it resolved we go to binding arbitration is ALPA policy not company policy. If the company’s in binding arbitration, yea we believe in binding arbitration.

P.S. Just a bit of clinical curiosity here, since you've posted that observation several times now; where, how and under what circumstances did you personally first encounter that concept? I'm not suggesting anything here, but, your being now a supposed adult; previously posted notions of school boys who apparently "got beat up a lot" at bus stops understandably begs some degree of curiosity there...?
