You need to learn how to focus. The case was dismissed (C-18), period, end of story. It's along the lines of that footnote which means squat which you are obsessed. The fact of the matter, is that you threw a fit and abandoned the process. You pretty much screwed yourselves. I don't have much sympathy for you except the 3rd listers, who deserved better representation.

USAPA Update

Regrettably, USAPA Vice President Kirk Atkinson has resigned effective July 3, 2015. The current national officers were elected effective April 18, 2015 and serve a three (3) year term, so the following provision of the USAPA Constitution Article III, Section 7 [C] applies:

In the event of a vacancy in the offices of Vice President, Secretary Treasurer or Executive Vice President, in which the unexpired term is more than (12) months, an election shall be held to fill the vacancy.

Ballot Certification has been notified and will schedule the nomination and election process.

The 9th didn't enjoin the company. They didn't enjoin the AAPSIC. They didn't enjoin the West Committee. And most importantly, they didn't enjoin the APA. If the APA establishes an East Committee, then how on earth does a non-injunction flow to a subordinate committee established by the APA?

USAPA is not establishing an East committee are they? Look closely. Read the footnote again. Slowly. The 9th acknowledged the two East and West separate lists... Just like the MOU and protocol agreement... and declined to enjoin anyone about using the Nic for anything..

P.S. We are all getting a refund from USAPA soon.. You should go buy a really big boat.

The 9th STILL slapped the APA granted merger committee named "USAPA" with an injunction. The 9th Knows with certainty that "USAPA" isn't an actuall, recognized labor union.  So....still there buddy? Listen. If the APA, ONCE AGAIN chooses to allow another east group named "it wasn't us" East Committee. There isstill no cover from the Injunction. Read the actual text of the decision.
 
I know changing your name kind of worked last time. Not anymore. The 9th reached out and enjoined the East pilots working under the name "USAPA" underneath the umbrella of the APA. There is NO difference between "USAPA" and the "It wasn't us" gang. Both allowed to operate by the APA. Your days of hiding behind a union name are 100% OVER.
 
So, the question is, Does the "It wasn't me" gang take their invisible ball and go home Once again if forced to advocate for the Nic?  Any money says they do.
 
One positive thing that came out of the East Pilot induced two month delay is it gives Silver plenty of time to write an Iron Clad Injunction. It's not like there's a single person involved in this on any level that doesn't understand what the East is attempting to do....again.

We love delay, as does the APA.  You forced delays on us for nearly a decade, and we've come to see the joy in it!

When The Honorable Judge Silver issues her ruling trust me, skip the dicta and go right to the remedy portion.   I am just trying to save you from renting another west pilot pre mature celebration tent for the "9th time".
 
Nor matter what the ruling, either side will appeal.  Sorry, have to go now and help an East pilot friend decide on another permanent bid due to attrition that johnny mac wants for himself, but accused the Legacy American Airline pilots from trying to steal east attrition from him, something he thinks he deserves due to saving the East pilots .......................  yada, yada.
