If you didn't like the NIC, there's a real good Chance you're going to go full Apoplectic when you see the result of this SLI.  I have always said that in the end, you'll be begging for the NIC back.

Wow. I actually agree with you! There's a first time for everything I guess. My opinion is a little more nuanced however. It's the East pilots who will be attempting to litigate anything and everything for years *after* the MB process has concluded. You guys will be on a multi-year, multi-million dollar self funded campaign attempting to sue your Union, Your Company, Leonidas LLC, the BOA, an attempt at SCOTUS...on and on.
 
The difference this time is you'll be at the bottom of a legal Grand Canyon trying to jump up to the rim like a grounded Chihuahua attempting to jump onto the roof; in frentic, flailing, spasms; foaming at the mouth only to end up dying of exhaustion - collapsing into a pathtic little sad heap.

Beyond the fact that you've never been correct so much as once; we've been hearing how truly "misinformed" we all are for well over 8 years now, from "You won't even get 200 cards!" on, and yet surprisingly are not the ones stuck for over a decade now out in PHX, left angrily wallowing around in perpetually adolescent self "righteousness" with nothing whatsoever to show for it other than some waay-cool-dude T-shirts. 😉

Gee, I really don't think I was wrong about the fake union being judicially forced to advocate for the Nic award.
 
How far did you get with your integrated DOH list? Sure put a hell of a lot of effort into that. Between the two integrated lists...DOH and the Nic...which one has more traction do YOU think?

The best thing for the West right now would be for an East committee to be appointed and for them to have no restrictions on what they can advocate for.

Everyone on the outside has seen the East's tactics and can look right through them. I think the panel is going to use the Nicolau list to integrate with American and they just want to make sure the East has no grounds for a lawsuit.

The less restrictions that are on the East and the quicker it gets done, the better for the West. No one has been fooled by their shenanigans so just get it over with and let them whine forever about it.

The new East committee, (minus USAPA) are free to bring whatever list they want but 9th ruling was meant to influence the arbitrators without usurping their authority.
That is the reason behind this:

The 9th removed USAPA, but left it open to be a fair process to all three groups.

The West got exactly what they needed from the 9th.
A ruling that USAPA was in violation of the DFR, that the Nic should have been used all along, and a fair unfettered arbitration can still continue (preventing more legal problems).

The East guys are delusional if they think the arbitrators wont consider the mountains of evidence that everyone else sees.
The 9th ruling is powerful evidence that the Nic should be used to some extent in aligning the East and West before then combining with the AA.

These arbitrators know that if they throw out the Nic, they ultimately increase the likelihood that their own future rulings could be ignored.
