Why not? The East pilots are paying Marty now. Who cares? Kind of makes the company look like the Non-neutral, West hostile group they've always been though. There's more hypocrisy in these proceedings than you can shake a stick at. Marty is doing a masterful job at highlighting that behavior.

The East pilots are not paying marty now, the west pilots are.  Did the army of lyyinitas stop asking for contributions or offer a refund?  USAPA is paying out of west and East dues money to their attorneys to fight marty and the self proclaimed west martyrs fantasy filings.  
 
 It is up to the arbitrators now, your attempt to threaten the company and apa is a waste of time.  It is in the arbitrators hands now who will follow the MB laws.

A footnote 4 from the west pilots on their September 19, 2015 pre hearing brief;
 
"4 We wish to make clear that while we have always believed quite firmly that the starting point for this SLI case should be the integration of the East and West lists as prescribed in the Nicolau Award and that the Ninth Circuit’s Addington Opinion only confirmed that belief, we are not asserting that this Board is bound to accept the Nicolau Award as a matter of law. This Board can impose any solution it believes is “fair and equitable” taking all circumstances into account. That said, for the reasons we set out in our initial Brief and that we reiterate here – with the added endorsement of the Ninth Circuit – we believe quite firmly that the Board should begin its list construction with that as the first step, no matter what methodology it ultimately chooses to integrate the legacy American pilot group with the legacy US Airways pilot group."

Ironically the MB SLI had their own footnote 4 when giving the ok to a East Pilot merger committee at the beginning of July, 2015
 
 
4 While enjoining the USAPA Merger Committee from participating in the McCaskill-
Bond seniority integration arbitration, except to the extent that it advocates the Nicolau
Award, the Addington majority recognized that, given the requirement of a ratification
vote by all pilots for any joint collective bargaining agreement, it was unclear whether the
Nicolau Award would have been implemented fully but for USAPA’s actions. Further,
the court expressly declined to order that an unmodified Nicolau Award be used to order
the seniority of the East and West pilots in the arbitration.”

Blah blah blah. What's to stop Silver from declaring the 2005 TA Complete and ordering the Nic effictive immediately? The arbs STILL won't have to use it in the SLI that the 9th was referring to. Their injunction is referencing the AMR merger. The AWA Merger is a whole different story...one that MB has ZERO influence upon. Remember Mike? Remember when you said you could cram a DOH list in lieu of the Nic because MB wasnt in effect? You were 100% correct...for once. Unfortunately for you, The tables have turned. Big time.

Oh, BTW, it is my fervent hope that USAPA is still spending former dues money on lawyers. I really do. Contempt of court gets one locked up in County Jail. I know 12 guys who would look good in prison orange.

The 9th mandate did not give The Judge discretion on that.

USAPA is using funds (america west and East dues money) to defend themselves from the appeal process west pilots initiated, this was allowed by the CLT District court and agreed to by marty.

This is the reason why west pilots were not hired by major airlines. Not a very talented bunch, think Darwin's Theory of evolution.

Funny how Snap and Metro cannot refute those facts.
Judge Silver is going to be all dicta, and very little bite. She cannot bind the East Committee to the Nic. Nor can she impose the Nic.

A lot of posturing from LAA pilots for their list. Same for the West. Too bad the arbitrators are the rule makers. The LAA pilots will certainly bear mention for their M/B Merit badges they earned in the past. Those and that " superior" jargon will go far.
The Silver ruling will be the final proof the Nic. Is not an binding item.
Waiting patiently.

You're assuming they're paying for this with misappropriated former union dues. Given the level of their collective stupidity, they probably are. Conrad will force the 12 idiots to pay for it or hold the defendants in Contempt. The C&BL aren't worth bird cage lining. Those are facts. Not my thoughts.

Rule 65. That's all you need to know. The BOA are most DEFINATELY not in charge of this.

I believe that it is a 100% certainty that judge Silver will issue an injunction.  Duh....That is exactly what the 9th told her to do!
 
The question is, who will be covered by the injunction?
 
On my give a shot meter, it is only registering about a 2 out of ten.  
 
Frankly, the east MC proposal is so laughable, it is gonna be summarily dismissed.
 
Now, there is of course the matter of legal fees.  Very interested in what she says there!
 
Once the BOA starts, um...nobody cares whether the east tries to delay, it will continue without you..  If the BOA grants more delay they have harmed the other parties.
