[background=rgb(245, 245, 245)]Earlier today the Company released its quarterly 10-Q SEC filing in which it asserted that the arbitrator for the LOA 93 matter has issued two decisions in US Airways' favor, regarding both the restoration and the 3% post amendable date raises. Although the Union does not normally disclose arbitrators' opinions when in a draft form, in light of the Company’s disclosure, we believe we have a very unusual and extenuating circumstance which dictates a change in this long standing practice of maintaining strict confidentiality -- for this specific dispute only.[/background]
[background=rgb(245, 245, 245)]Last week, the Parties received a revised draft opinion from Arbitrator Kasher on the restoration of pay rates that the Union believes was due on January 1, 2010, and an additional supplemental opinion on the issue related to the 3% raises which we believe were due each May 1 beyond the amendable date per the Restructuring Agreement.[/background]
[background=rgb(245, 245, 245)]The Grievance Committee has previously disclosed that the Union had not prevailed in the draft opinion from the Arbitrator on the restoration question. The draft opinion on the 3% question provided by the Arbitrator last week is also unfavorable to the Union. The draft opinion on the 3% contains troubling factual errors, inconsistencies, and an apparent misunderstanding of the question raised. In order to preserve the integrity of the process we are not able to provide specific details of the draft at this time, but we have requested an Executive Session with the Arbitrator as a matter of urgency. We know many will have questions, as do we, but we believe it prudent to make every attempt at using the process afforded us in advocating the Union’s position before we disclose any further details. Please understand that we will be unable to expand on the details until the System Board process becomes final.[/background]
