Who is going to defend the "NIC" AOL? Not their award, ALPA said they won't in the NAUGHLER, USAPA sure won't, Dual ratification, and BTW no "ALPA" merger policy in place to cover it! SILVER and the 9th got it correct, "A BARGAINING PROPOSAL" and a windfall for a particular group, I believe a LUP is a contract with decent gains benefitting "ALL" parties!

Benefiting the east with 90% and the west 10 %. Not really benefiting equally.

If the Nicolau is a bargaining proposal but has been accepted by the company. What would you call a DOH list that the company has refused to even talk about?

I'm a little weary of the faceless volley back & forth. You east folk have even outed some of your own that oppose your date of hire land grab.

Many of you have guessed correctly. I have the same moniker that I use everywhere: Cactusboy53. It's part of my e-mail address.

I am Dave Simmons. A PHX based pilot on the Airbus, and a current PHX representative. It is my goal to represent my PHX based pilots to the best of my ability.

It is my agrument that simply changing the name of the CBA & its Constitution & Bylaws does not allow the new CBA to cherry pick what portions of the contracts, letters of agreements & side letters that it wishes to follow. The Nicolau seniority list is the only existing legal seniority list, and IMHO it will be the only one used in a JCBA within our organization and/or with any merger parnter.

DOH a west captain goes junior to a east furloughed pilot. You had better look up the definition of windfall. Figure out what integrity is. A group with integrity would never allow a furloughed pilot to be senior to a captain.

Read the transition agreement and the court findings, you will find your answers. You are furloughed, will never be called back and the nic is dead, get over it.

Well I am sure they accept anything that benefits their position, just as DUI said in his crew news "IT is for you guy's to decide" quite the departure from the AOL accepted position junior!

The East screwed up in it's demands for straight DOH, but that doesn't change the fact that there was a reasonable expectation that the arbitrator would be fair in any case. He was not and every day bares that out..

The award was basically the same as the Shuttle award and the Delta Nothwest award, were those unfair too?

1) You throw the term "seniority" and the many more work years of others beyond yourself around in similar fashion.
2) None, no one, not anybody has intruded into your magnificent little desert empire and displaced any of you. It's not anyone's problem but yours that PHX isn't turning out to be the powerhouse you previously fantasized it to be. The "evil easties", "eastholes", whatever, would have happily provided for those in PHX to bid east, based on DOH. How's the whole "Army" ahem, of "Leonidas" bit been helping you?

How come you don't do something about the west recalls flying junior to "third listers"?

How come you and your two BPR reps let Szymanski keep telling everyone they represent ALL the pilots when in reality you don't want them representing you?

How come you support the leadership instead of telling them and Wilder that until THE COURTS settle the seniority issue once and for all there is no contract?

Would you support a recall of ALL four officers of USAPA in support for leadership that will say there is NO list until the courts settle the list? I mean, really, that's what your suing about anyway. I ran for VP but didn't get it because you guys supported Koontz instead of me and look who you got, your ole buddy Steve.

How's that working for ya?

You and yours certainly throw "captain" around like a toy. Reference Auxler and Anger video tapes.
A group with reality would never discount another's years of service to the SAME COMPANY fly junior to anyone else short of that individuals choice.

I was hired in 87 and I would be junior to the recalled west pilot I flew with the other day.

Told him I'd rather scab than fly junior to him. My bloods as red as his, why should he get special credit for his years over mine?

Shuttle was wrong and it wasn't the same. In fact Nicolau actually gave them more slotting credit because of their AGE. Go read the decision again. Should have been DOH fencing to base. I tried to support that with my reps at the time but they just wanted to stick it to em. ALPA merger policy screwed them, remember?

As far as Delta-northwest they negotiated their seniority provision in the JCBA WITH an arbitration provision....we didn't. And now Roland Wilder is supporting that same direction with the next merged contract with APA if it happens. What a joke. But I'll say the the Delta Northwest contract had so much upward movement still with fences that to them it didn't matter.

You know what, D.E., why don't you tell everyone here you support the Piedmont principle like your dad? You know, the "I'm piedmont and I fly the 767 which makes me more special than everyone else in the world? Heck, if that was the case I don't need to be on any seniority list either, I'll fly PIC on the 767 or 330 or whatever whenever the company calls.

No realistic, measurable and objective standard of how we value each other is going to continue to whipsaw the industry. There is even a drive at APA to keep the merger from happening because of us and our seniority issue.

Hope you and the west enjoy your contracts, I know I do because I'm enjoying my two weeks of not flying over the holidays because of the reserve system! Life is great.

We didn't vote for either of them because their logic is flawed and will continue to be as long as you support the current track. How about a paradigm shift?

I can only pray that I've not offended God Allmighty by disparaging any recently annointed, west Bibilical "Heros", "the apple of God's Eye", such as their newly-christened "King David"....last seen gathering deadly, smooth stones for his mighty sling, while telling us much lesser, mere mortals to "man up", purely for internet chat purposes, of course. 🙂

To you and all rational and decent west folks: I mean zero offence, any/all of our differences aside....but...you've got to admit that it's impossible not to be both amused and amazed at some of those that "represent" the west position here...as well as we on the east at times. 😉
