The folks who would be suing for a non-DOH list would be a slim minority of folks on the bottom end of the scale working cheek to jowl with the same folks they are suing. Not likely to fly IMHO*. The west is suing from a distance and is 100% unified.
If only USAPA understood the value of unity.
* My previous post mentioning a possible lawsuit was to illustrate USAPA's constitutionally binding itself to DOH, more so than the likelyhood of a successful suit.

The point is whatever seniority scenario is voted in by the majority, the opponents of that agreement is going to have a rough time getting any court to overrule it. On either side.
USAPA is USAPA and I think anybody can see that there is not much unity on the east when it comes to who is doing what in the BPR, or compass correction, or recall efforts or Chips crowd. Where the unity of the east comes into play from all indications that I see is the fact that no NIC can get ratified.
It IS going to go through the full court process no matter what happens. If we are sure of anything over the past 7 years we are sure of that both east and west.
Doug knows it also, and it is quite apparant in the last crew video in PHX. They stood up there and told the west exactly what they will see in 2013 and made no bones about it. No movement, no recalls, no hiring. And in their words the only thing keeping the west at the level they are now is the east flying that they are doing.
Basically he told the west to have at it with the lawsuits etc, but that he was moving on with hiring on the east so the west knows what they can expect for the duration of this process. What really would worry me if I were on the west was when they questioned the "rumors" that the new hires were being told they would probably upgrade in 5 to 7 years. To cut to the chase the answer was "yes" and in the explanation not once was the word PHX or west pilots used. there was lots of detail about the east retirement numbers, plus the new rest requirements coming up etc. That one item by itself tells me the company is done with the games and that the west has been put in hibernation for how ever long they wish to pursue the venture.
