Cashing in a lottery ticket? USAirways East pilots are lucky to still be working. Them's just the facts. Career Expectations at AWA were upgrade in what????? 6 years? what was upgrade in the East? Lets see, bottom guy was 17 years (about 10 years of Furlough time?) and bottom Captain what? 23 Years? Lets see 6 or 23. Career Expectations were a lot better in the West. Look it up yourself.

Ok, if that is what you think. I guess that gives the west the green light to have your way, and sodomize the east pilots. The bottom line has just been delivered by the 9th. Better pay attention, because it is abundantly clear the 9th did not see the lack of inclusion of the Nic as an obstacle. There is going to have to be a fair integration going forward, but it is not going to be the Nic. If you don't see that part in their message, then you need to re read it,

Freebird, Career expectations and America West in the same sentence. What a Joke. There was movement because pilots left for better jobs. The pilots that stayed must have liked the pay and non benefits.

if USAPA hangs on to straight DOH and West hangs on to the Nic, we will go nowhere...for good.

You alluded to the biggest part of the problem, IMHO.

There is no "west" anymore from the standpoint of a certified bargaining agent. How does USAPA try to compromise with itself? If there was some way to make a "west" unit magically appear to be appeased, who gets to represent the "west"?
 
So it would appear that any menaingful tampering with the Nic award could very well end up with the same verdict against USAPA.

How kind of you to make the decision and save all the time and costs of another court case.

Who is to say that the next judge will be as cozy with the Addington plaintiffs, or their successors? Will the next judge be just as willing to suppress evidence for the next jury to hear?

The outcome of another trial might be very different.

Here is another point to consider...the 9th District Court ruling was NOT unanimous.

The Supreme Court case of Bush vs. Gore in 2000 was not unanimous either. We know how that went. What weight was given to the dissenting justices opinions? I will answer that with another question: Who was president in 2001? What did the dissenting opinions get for Gore?

FUD mongering is exactly what the ninth saw and dismissed it. There will be a few who try to nurse it.

We will vote on a contract. Who knows if anyone will have enough heartburn with the outcome that they will try to raise the money to sue.

Ironically if Wake had done his job correctly, we all would have likely moved on by now. Even so, if there were people still dead set on suing, they would still have money in their pocket to do so.

Actually Jim, though I respect your opinion, The ruling did specifically state that DFR wouldn't be determined until such time a CBA is voted in, and then it would be determined by what is contained within that CBA, and just simply the absence of the NIC would not necessarily constitute a DFR....

Baring a merger announcement, or a new representational election, the next milestone for our pilot group will be the vote on a CBA that our union crafts in negotiations with the company. Those who are contacting their union in a civil way are having an impact on what they will get to vote on.

Are you at all familiar with USAPA's track record for either negotiating with the company (by torpedoing any merger possibility and antagonizing management with silly newspaper ads) or giving a rats --- about the interests of the west? USAPA is a microcosm of the current US Govenment: disregard the welfare or the opinion of the electorate and do what you want, all the while alienating your allies. That strategy will only lead to their ouster at election time.

Hey, as it applies to USAPA, that's hope we can all believe in!

Sour Grapes?

Would you call the fact that your side agreed to Binding Arbitration (do you even know what that means?) and couldn't live with the BINDING ARBITRATION outcome, sour grapes? If not, why?

To use the same arguments against you......the 9th has spoken.......the "YOU AGREED" argument.....is a monumental waste of good
time and space. At this juncture...NO ONE CARES WHO AGREED......DEAD ISSUE.

Exxon waited 15 years to get 2 BUSH pro-business types (Roberts, Alito) on the Sp.Ct to get their Exxon Valdez 5 BILLION punitives lowered to 500MIL. It happens....get over it.

Went over to the army of leonidas web page to check out what is being said there......and it's not there.
Guys, I don't know if I'd contribute to an organization that can't keep the website up.
USAPA rocks.
