Brookman was smart enough to try and warn his guys not to vote for LOA 93.This was his take on it to scare his guys off, Take it for what you want. He voted against it, and it is his opinion only.

Well, well, well. Two Easties - one claims Brookman said that to "scare his guys off" and the other says Brookman was right but then ignores what Brookman said. "There are no snap backs or provisions for the pilot group to recoup any contractual provisions, benefits or pay during for the next 5 years, and realistically under the provisions of the Railway Labor Act, it may take up to 2 additional years to negotiate any changes to the collective bargaining agreement."

Hmmm - NO provisions to recoup ANY benefits or pay until a new contract is negotiated....

I wouldn't put much faith in what Brookman said about anything. If he said the sun was shining, I'd look outside. I consider him to be one of the three architechs of LOA 93 since he, the PIT Captain rep and the Chairman of the Negotiating Committee decided for all of us not to take what the company had on the table and forced us into an even worse negotiating position... all in hopes that it would be voted down. It almost worked. Glass saw us coming. We were amatuers negotiating with professionals.

For me, I'll just take it as it is written in LOA 93:

"The rates of pay specified in Section 3 of the Agreement, as modified by the Restructuring Agreement, will be revised as follows:
1. Freeze current rates effective 5/01/04 through 12/31/09.
2. Reduce rates as frozen by 18.0%
3. Reduce International pay override, as stated in Section
3(F) and Section 18(C), by 18.0% for transoceanic trips;
eliminate international override for non-transoceanic trips.
4. Pay all flying at day rate."

I think line 1 speaks for itself. The rest of the LOA was amendable on 12/31/09.

I really don't care what he said or didn't say. I just thought it was funny that MM and NYC disagreed with each other. Of course, NYC had to disregard part of what Brookman said to conclude that he was right - funny in and of itself.

Unfortunately for those hoping for victory in the LOA 93 arbitration, the company had people that were on the negotiating team as well as the info the MEC put out on the pay reduction that indicated that Brookman was right - there was/is no automatic return to LOA 84 rates contained in LOA 93.

What most don't seem to understand is that there's one, and only one reason the "freeze" is there - to end the LOA 84 annual raises. Without language to accomplish that, the pay rate would have initially been reduced 18% but gone up every year due to the annual increase - at the end of 5 years most of the reduction would have disappeared. The line containing that word "freeze" prevented that.

You make a good argument Jim. I suppose it all comes down to interpretation. I re-read the transcripts the other day, particularly Mowery's and Bukovic's testimony. They made a very convincing case. But I'll concede, I am biased and I don't give it much chance based on our track record.

Could care less about defending Brookman, but you simply are wrong about the way this went down. Brookman had absolutely nothing to do with what was actually in LOA 93. In fact he was the ONLY one with questions (specifically about scheduling) when it was presented to the MEC. I was there. The other Reps were upset with him for taking so long, guess they all had flights home.

Look to Bill Pollack if you want to find a single individual to blame for LOA 93. But it was the line pilots who cast the votes, just like they did on 190 rates. The enemy is actually us! And don't forget to look where Pollack and our old CLT ALPA rep (who had no relation to LOA 93 dealings) are working now. Pollack now makes more than any pilot working the line, apparently the Company thinks he deserves it.

President Cleary next relayed to the Board that he had just been informed that the FAA Certificate Management Office (CMO) was proceeding with enforcement action against US Airways for operating from Larnica, Cyprus (LCLK) on May 6, 7 & 8th without ETOPs authority. Thanks to Captain Rick Brown who was very helpful with the investigation. Please Click Here to read the June 16th Safety Update for a re-cap of this story.

Hey Metro, sorry I mean Res, kind of like your Asst. C/P that stole info from the company, our Asst. C/P got us violated, kind of ironic huh? You can steal info, endanger lives by lying to a flt crew, but you get fired for not doing you homework (aka distance learning). Hey, where else can that happen. B)
