Something that applies to everyone here unless one of the 3 pilots is here and staying mum. That's why I've stayed away from pointing fingers at either side, unlike everyone else who "believes" one side or the other.

I have no idea - a judge can do anything he/she wants subject to appeal. Reading the evidence submitted, I think the company has the stronger case, but that doesn't mean the judge will rule for the company.

I quoted you the FAA statement, as published by corporate communications in it's attempt to gloss over the event, that supports Captain Wells' version of events and contradicts mr. Eagle's. Yet you ignore it. Hmmmm.....................no bias there, right Mr. AWAPPA?


Franke Air had extremely lax requirements. This one is proof positive of that. Most likely trained by Orenstein, another spawn of Franke.

If forced to pick only one thing, it would probably be Lee's report. The statistical concepts went over my head but the judge is presumably not a statistician either, so those lines on the charts paint a pretty clear picture that something changed on the East side on a specific date.

His compensation indicates nothing about the veracity of his report - experts who don't work for one of the parties are routinely paid for their time. Heck, even experts who DO work for one of the parties are paid their usual pay to testify. To use a Pi tactic, if Lee's report was full of holes why didn't USAPA's lawyers call their own expert witnesses to refute it?

USAPA's defense, to me, seems to be largely that it didn't do anything to cause or further a slowdown. My understanding of the law from both the APA and UAL Alpa cases is that that doesn't matter. Being responsible for the actions of it's members is one of the costs of representing those it represents and being empowered to "confiscate" (I don't mean that in a pejorative sense) money from them under threat of termination.

ps - I see the change in your post since I started typing my reply. As I've said, I seriously doubt that every East pilot, or even a majority, was involved if there was an illegal slow down. 100 disgruntled pilots could cause the effects Lee showed. So expecting the average for the entire East operation to change large amounts is unrealistic. What the judge has to decide is whether Lee's report, together with everything else, indicates that at least some East pilots engaged in an illegal slowdown or not.

First, I added to that post after seeing the change in your post, so re-read my reply to get the changes.

Pi has made much of the company's lawyers not cross-examining the flt 718 captain, although there could be perfectly logical reasons why they didn't (one of which is mentioned in the transcript). Apparently he takes the lack of cross as proof that everything she said is "the truth, the whole truth, and nothing but the truth".
