MEC Chairman’s Message
January 26, 2008
This is MEC Chairman Jack Stephan with a Chairman's message to the pilots for Saturday, January 26th.
This past week, your union has been involved in several activities, addressing many issues that are of importance to you.
On Tuesday, the Council 90 officers held an informational meeting in Charlotte. This briefing was well attended, and it gave our pilots the chance to talk to the CLT reps, MEC Officers, ALPA staff and advisors, and several of our MEC committee chairmen. It also gave me the chance to talk to many pilots—both ALPA and USAPA supporters, face to face. It is always good to get our important issues right out on the table. As I have stated many times, I respect the right of pilots to choose their union representation. However, when making a decision that will have such far reaching effects on your pay, benefits, your working conditions, and ALPA’s current efforts to reach consensual modifications to the Nicolau Award that would survive future mergers, it's crucial that you receive and analyze all the information required in making the right decision. Too much is at stake to rely on rumors—you need the facts, and plenty of pilots were on hand Tuesday in CLT to get the facts and talk about your concerns.
Rumors are what lead me now to talk about some very serious misinformation that was recently posted on the US Airways pilots web board alleging that ALPA attorney Jeffrey Small had stated that if USAPA is voted in and the Nicolau Award has not been implemented, that the Nicolau Award will not survive.
This information is legally inaccurate and the subsequent web board posts have been very misleading. ALPA attorney Jeffrey Small not only denies ever making such a statement, he also states very clearly that:
“A change in union representation does not nullify or modify the Nicolau Award, regardless of which union serves as the bargaining representative.”
The most likely result if USAPA or any bargaining agent attempted negotiations with the Company to mitigate some of the effects of the Nicolau Award would be to secure some protective contract language; protective language that would some day be amendable. I’m sure you all share my skepticism over the permanency of any such contractual fixes. That is why the ALPA process is seeking consensual solutions with the AWA pilots that can be made a permanent part of the Award itself.
You can read what ALPA's legal counsel has to say about the renegotiation of seniority lists under the January 13th entry of What's New. It has also been emailed out to all pilots.
Also this week, as reported on the code-a-phone, the US Airways MEC three-man panel, made up of Garland Jones, Don Iorio, and Rocco Spartano, met with their AWA Steering Committee counterparts in Las Vegas and determined that sufficient common ground exists to continue discussions. With both Steering Committees agreeing upon protocols and rules of engagement, they have now agreed to meet in an extended negotiating lock–
down session that will begin next week for substantive discussions in order to address the issues of importance to both pilot groups.
Relative to the Steering Committee, I would like to address some confusion that may exist about previous MEC resolutions and how they relate to our current Steering Committee activities. Our Negotiating Committee members, who are also JNC members, are offering advice and support to the Steering Committee as is our Merger Committee. To ensure that our Steering Committee is not restrained in any way during this process, they enjoy full access to the expertise and technical knowledge of any and all of our committees, including all of ALPA National’s resources. This process is simply too important not to provide our Steering Committee with everything they need to arrive at a solution.
If an agreement is reached by the two Steering Committees that results in a potential comprehensive counter proposal to management, that proposal would first have to be accepted by both MECs for JNC negotiations to resume. And consistent with our past resolutions, that counterproposal would not only have to adequately address our issues with the Nicolau Award, but parity and retroactive pay as well. If the proposal is found to be acceptable, our MEC could then, through resolution, re-assign our Negotiating Committee members back to JNC duties in order to engage in JNC negotiations with management.
Later next week, AWA MEC Chairman John McIlvenna and I will send all AAA and AWA pilots a letter that outlines the process both Steering Committees will be engaging in and explains the communications protocols that both sides have already agreed to.
I'm pleased to say that both the AAA and AWA MECs are supporting this process, as is ALPA National, both financially and through their considerable technical resources. With the advent of these talks, we are entering an important stage for both pilot groups, and it's necessary to give this process every chance to succeed. This may very well be our last chance to address our seniority and contract concerns in a consensual manner.
Yesterday, MEC Vice Chairman, Kim Snider, met with ALPA’s Merger Policy Review Committee. Kim spent a considerable amount of time detailing his experience with mergers as well as explaining how current policy could be improved. The Committee has also asked for my input and I will be meeting with them next month as well as attending a meeting called by Captain Prater of the Chairmen of the largest MECs in ALPA to discuss the current trends and events in industry consolidation.
There is no doubt that things could unfold rather quickly, so continue to look for the latest information in the MEC code a phones, NewsDirects, Chairman's messages, and Chairman's letters. We remain in uncharted waters but your MEC through many meetings, long hours of hard work and debate, has taken great care to chart our course. We are fully prepared and we ask that you stay informed and dismiss rumors for what they are during this process.

WHEREAS this September will mark two years since the merger between US Airways and America
West Airlines, and
WHEREAS US Airways management has benefited from scope relief granted by the US Airways pilots
allowing the use of the US Airways marketing identity on America West flights for nearly two years, and
WHEREAS there has been little substantial economic progress made during Joint Negotiations for both
pilot groups, and
WHEREAS there has been a disparity of pay between the pilot groups since the onset of the US Airways
and America West merger, and
WHEREAS this disparity between the two pilot groups has increased due to the recalling of US Airways
furloughed pilots that are not at top of scale, and
WHEREAS the America West Pilots received the support of the US Airways pilots in dealings with
management that culminated in the America West pilots successfully achieving substantial gains in the
areas of Defined Contribution Retirement Plan and Corporate Profit Sharing Plan, and
WHEREAS since the US Airways and America West Merger, management has seen fit to grant other
employees pay and parity raises throughout the corporation, a

WHEREAS US Airways management continues to reward themselves with lucrative compensation
packages, and
WHEREAS the profits are reported separately for US Airways and America West by the company, and
they indicate an extreme disproportionate profit generated from the East operation resulting in East
profits disportionately funding items such as West profit sharing plans, other employee raises and
executive compensation packages and
WHEREAS the Transition Agreement envisioned substantial progress being made by June of 2006, and
WHEREAS Management has intentionally manipulated the timeline and slowed the progress of the JNC
process, in particular during it's ill conceived hostile takeover attempt of Delta Airlines, and
WHEREAS during that failed Delta Airline Takeover attempt, management clearly promised that all
pilots would be brought up to the highest contract of the three pilot groups, and
WHEREAS CEO Doug Parker on July 26, 2007 during the 2nd Quarter Report publicly stated that US
Airways has already budgeted 122 million dollars for 2007 and beyond for the assumed cost of matching
US Airways pilots pay with America West pilot pay plus an additional three percent, and
WHEREAS also during this same public forum CEO Doug Parker declared that employees performing
the same work should be paid at the same level of pay, and
WHEREAS the expense of continued fruitless negotiation is not in the best interest of the US Airways
East pilots.
THEREFORE BE IT RESOLVED that the AAA MEC immediately reassign our members of the JNC
back to Negotiating Committee duties, and
BE IT FURTHER RESOLVED that our members of the JNC will not reengage in Joint Contract
Negotiations until the US Airways Pilots are provided parity with our Brother and Sister pilots at
America West, and
BE IT FURTHER RESOLVED that parity is defined as pay as put forth to the company in our June 28th
proposal, and
BE IT FURTHER RESOLVED That retro pay for all US Airways pilots will take affect starting
September 1, 2007, including a fair interest charge of 8% that will be calculated onto any future
agreements, and
THEREFORE BE IT FINALLY RESOLVED that the US Airways MEC authorizes a media campaign,
including but not limited to informational picketing and other forms of lawful demonstrations, in order to
inform the traveling public of the un-American pay discrimination that the professional union pilots at US
Airways have been enduring for the last two years.

This really is one of the big issues, that the east cant seem to grasp, no matter what the east just dont get, it wont sink in, no matter what evidence is provided, what common sense, what history. They fail to acknowledge the facts. The East is like a person with cancer that is in denial.

I am sorry but your company was gone, there was nothing left, you were going to chapter 7 within the week before white knights saved you. (it is all in the BK docs). The company you worked for in your life time was gone, it was a very crummy company with very poor leadership in a very poor economic time.

If the EAST ever realized the truth, the absolute facts then maybe something could get done, but they wont. Plus others on this board have stated their intent is to close down the company, so it really does not matter anyway, some of the east just work here in order to cause havoc to get the place closed because they have other jobs, other business;s, some are staying at us air just to close them down, that is their stated goal. They want to put over 30,000 people out of work. You just cant reason with that sadistic mindset.

I tried to show some respect for luvin737's post, it did make sense. However, your dog piling post sucks. I never said anything like, ok....you are right, I suck. I said that I would tone down my posts in the future.

This is what the eastern pilots can expect when you prevail over Franke Air in your pay dispute. Franke Air rolls out the minions who plead, and expect you to carry them because they are dependent on you, to carry them because they failed to achieve any standing in life. Carry me pilots! I am dependent on you! I expect you to continue to subsidize my failings, and the way Franke Air does business. Franke Air can suck the life out of the company with bonuses, but I have pilot envy, so I focus on you because I most likely barely graduated from high school. I have little intelligence, so I am easily directed by Franke Air in your direction. Franke Air can continue to suck millions out of the company, but I will focus my feeble mind in your direction. Franke Air raises devoted, and dangerously stupid disciples. Beware of stupid Franke disciples in large crowds, for they are easily directed. This is what you can expect when Franke has to pay up. Laugh in the stupid disciples faces.

Fellow pilots,
One of the questions that came up at the briefing on the 22nd of January was our allegiance to ALPA.
Let us be clear: the instant we feel that there is a better option than ALPA for the representation of our pilots, we will resign from ALPA.
There is no room for “double agent” activity in the representation of the pilots of USAirways. Working at cross purposes to the best interests of our pilots is simply wrong.
ALPA is not perfect, but it is the best option we have.
There are many reasons we are certain that remaining with ALPA is a good idea. We held the informational meeting in Charlotte to provide you with access to information and people so that you could examine your own reasons. Many of you have asked that we hold additional briefings in Charlotte and we will do so on Wednesday, February 13 from 10:00 am to 4:00 pm in the conference room behind the Charlotte Business Center on the main floor of the food court in CLT.

Hey CM,

He proceeded to rearrange the bags EXACTLY in the same fashion that I was doing. I noticed that he was so wound up in his paper work and all the notes that he had during the flight that he could barely keep up with where the aircraft was on that leg. Also, the Cpt and the FO said very little to each other throughout the flight. Strange dude.

Why am I telling you this? Honestly.....and I swear to God, I just couldn't wait to finally get to Philly and unstack the bags to see if your name was on his bag tag. I just knew it was you.

This 3 percent figure is very telling. The company has so far refused to pay it since Dec 31 2009 as part of the pay restoration as it would be admitting they agreed with the other tenets of LOA 93 pay restoration as the 3 % is part and parcel every year. This figure did not come out of thin air. So they refused to pay it. If they agreed to it, it means they recognized the validity of the other aspects of LOA 93, which included the pay restoration. They attempted to cherry pick the parts they wanted, but inadvertently admitted they were agreeing to LOA terms. The fact Parker mentioned it, and said they were going to pay the 3% is indicative they were absolutely familiar with their obligations under LOA 93. They took their chances, and hopefully very soon they will be forced.

1. ITT is simply a satirical look at the path we have been forced down. Sorry if it (and the TRUTH in it) hurts your little feelers.
2. You guys do a fine job all on your own assaulting "the professionalism and commitment of the pilot group", you don't need our help.
3. If your feelers are hurt because we make jest of your antics, it is only in response to being called DRUNKS, LOSERS, SLACKERS, SUCKERS, SCUM, SCABS, SEMI-SCABS, oh and ROOKIES. The only thing that you are leading this industry in is FOLLY.
4. Move2CLT is one of many that are tired of your whining, chest thumping, & seeking some sort of compromise from the already compromised position. You really expect us to "accept & embrace" a group that is fully willing to steal what does not belong to them (using our union dues to do so)? USAPA's patron saint: ST. Happenin'
5. USAPA is THE VEHICLE that Bradford started up to get us here, and it is a FACT that he did so as the means to evade a final & binding seniority award.

The Nicolau list didn't make this personal, YOU DID. Any person or group with INTEGRITY would have (while upset) accepted the list and moved on to complete the joint contract. YOU DID NOT. Further, your stellar legal team has now collected over 10 MILLION dollars of OUR DUES money with a PROMISED slam dunk. Guess what? NO SLAM DUNK, but the legal team has left the building!
