Today attorneys for the West filed “Notice of Ruling in Related Case” in the Airways Declaratory Action case. You can read this filing here. The purpose of this notice is to inform Judge Silver of the developments in a related case, the injunction against USAPA. Judge Conrad’s comprehensive Findings of Fact and Conclusions of Law are attached to today’s filing as Exhibit A. Ms. Kelly Flood authored today’s filing and she uses Judge Conrad’s findings to once again ask Judge Silver for expedited consideration of the pending motion for West pilot class certification:
“As demonstrated by US Airways in its injunction action against USAPA, labor unrest has damaged the airline and its employees, and has caused great inconvenience to the flying public. Such unrest will continue until CBA negotiations are completed. CBA negotiations cannot be completed until there is judgment in this case on the merits. There can be no judgment before there is class certification.” [pg.4]
Many significant events are starting to unfold, both within US Airways and within the airline industry. Last week we had Judge Conrad issue a comprehensive injunction against USAPA for engaging in an illegal job action. Tomorrow USAPA must satisfy Judge Conrad that they are complying with the injunction order in good faith, otherwise the union faces the prospect of being held in contempt of court. Contempt sanctions can range from fines in the order of millions of dollars, and imprisonment of union officers should Judge Conrad find that they are directly responsible for the contempt acts and refuse to comply with the injunction. In the next week or two, it is likely that a decision will be published on LOA93. On top of all that, airline stocks are crashing, notably AMR which is widely speculated by industry pundits to be a merger partner with US Airways.
Nobody knows how those events will unfold, but we are feeling confident at Leonidas of our legal position with respect to the Nicolau. The West pilots have delivered to fund the legal defense of their careers, but keep in mind that we are not finished yet. We are planning another “meet and greet” with the attorneys next month, tentatively scheduled for November 8th. That date might change and we will do our best to nail the exact date down before the November PBS bid closes, but for now it is looking like November 8th will be the date. The venue will be different from past meet and greets; this one will centered around a “happy hour” timeframe. Let’s aim for a large turnout and please bring spouses. Now that we are finally getting determinations on key events (injunction case and LOA93), the attorneys will be able to speak with greater precision as to the legal landscape affecting our careers. Look for details in the coming weeks.
