I don't think you can change unions without a NMB election, but USAPA could merge with the IBT without one. In theory, at least, USAPA could still be the representative - that seems to be the case with AFA after they merged with CWA to become CWA-AFA. I don't know anything about the nitty gritty details though and since USAPA would be a small union compared to AFA I'm not sure what the benefit would be for the IBT unless they got the dues money and called the shots (leaving little to nothing for USAPA to do).

"Merge" might indeed be the correct term..but I believe the entity USAPA could disappear at some point if that is what the pilots wanted. This is addressed in the CBL (note it says NMB "or" 2/3 vote.)

"B. Dissolution of the Association may be affected through a representation vote conducted by the National Mediation Board (NMB) in accordance with the Railway Labor Act (RLA) that results in the Association’s certification being extinguished or pursuant to a two-thirds vote of the Board of Pilot Representatives subsequently ratified in accordance with Article XI, Section D of this Constitution and Bylaws. In either case, the commencement of dissolution is subject to the deferral provisions of C. of this section."

Do you think IBT wants to inherit litigation with the prospect of significant damages awarded? I think Hoffa will tell Cleary to clean up his own mess first.

Yes, dissolution is a third option - the NMB has no language concerning that that I know of and I doubt that they have the authority to force a union to continue to exist. But that would leave the pilots as at will employees, at least till an election could be directed by the NMB for a replacement. Assuming that most pilots wouldn't want to be at will - a lot of unpopular changes could occur in a couple of months - I didn't see that as a realistic option unless it was forced by economic circumstances and then a vote wouldn't matter.

You did not ask me....but

I already had a good cry about LOA 93 when Move2CLT told me last month we had already lost. That cry lasted about 30 seconds.

Does not matter what happens in the DJ. Either way the Company is going to take it to the Ninth, so who cares. 2-3 year wait in my opinion, and no doubt in my mind what they will say in San Francisco. I have had much longer waits in my life to achieve goals, hunkered down for the duration on this one. I am serious.

I don't believe the company will take it to the 9th. The DJ will be it and the meeting in December could be the end all. Even putting that aside and assuming that you are right (and knowing the Kasher decision will be out soon) What is the plan should one or both of these decisions go against the usapa faithful. I am asking a serious question.
 
I am uninformed and undecided on all things IBT. But a "card drive" is not necessarily required. All the governing body of USAPA has to do is make a decision to ballot the membership, and if it passes we could change unions, affiliate, etc.

I don't doubt your comment that the governing body of usapa can ballot the membership but I do doubt that usapa has a governing body. The way I see it Mike Cleary does whatever the hell he wants to do and "the governing body" is nowhere to be found.

Their actions are a clear indication that the east knows they will lose. The only plan B they can come up with is to once again change unions in hopes of yet another do over. Their desperation is entertaining in the least.

I hope the Easties find this entertaining. It's the most expensive entertainment they'll ever pay for in their entire lives. Close to a billion dollars of lost income...no end in sight....unbelievable. :lol: :lol:

Don't worry about them. They all say its cool and they actually prefer LOA 93 so they must be happy to be getting what they want.
